PCN unauthorised by land management

    In fairness, the email does not reference the address, only the name of the apartment building, but you'd think they would check -

    Email to be used as evidence below (from associate director of management company):

    Dear Sirs

    I am an agent from XXXXXXXX, which is responsible for the management of the property XXXXXXX.

    I have reviewed the photographic evidence and I can confirm that XXXXXXXXXX have never given permission for Vehicle Control Services LTD or Excel Parking permission to issue parking charge notices on any part of XXXXXXXX property.

    I can confirm that signage from the vehicle control company (as evidenced in the photograph) was put up on XXXXXXXX property without permission during March 2016. XXXXXXXXXX requested the removal of the sign as soon as we made aware, as it had been erected illegally.

    As such, any parking charge notices that were issued on XXXXXXX land from either Vehicle Control company, were issued without permission of the managing company of XXXXXXXX. As such, no breach of contract occurred when XXXXXXXXXX parked her car on XXXXXXX property.

    Proof of these statements can be provided if required.

    I would let this go to court and let VCS get spanked again, you claim your costs and then unreasonable costs as happened here

    Today was the deadline for the DQ. I've looked on MCOL and it says Claimant DQ received today, but does not say that mine has. Have just tried to call MCOL to prompt them but got cut off before I got to the front of the queue. I will try call again tomorrow. If I can prove that I emailed the DQ on the 25.1.2020 (as I received email reciept) will this be ok?

    If you received an e-mail receipt you should be fine. Sometimes the CCBC gets backlogged.
