Hi All, As promised heres an update of case.
Yesterday i received a letter from mcol and is headed ‘Notice of allocation to a small claims track’ It states the judge has considered the statements of case and directions and allocated the case to small claims track. Just under this it says that unless the claimant does by 16.00 on **/**/20 pay the court fee of &25 or fill in a properly completed application then it will be struck out with effect from the date given above and unless the court orders otherwise then the claimant will be liable to the defendants costs incurred.
So would i be right in assuming vcs are somehow trying to call my bluff and may stand down at the last minute before the deadline for court action? Or it this just a standard letter most people get before the court date?
Many thanks for any reply. Loretta0 -
They are not calling your bluff0

Hi Everyone, latest update:
Yesterday i received a letter from VCS and before they commence court they have offered me a last chance lower amount of £125 (instead of £185) to pay in order to try and resolve this case before it goes to court. They urge me to take the ‘offer’ as the say they have a strong case against me and will use this offer in court to show they are trying to be reasonable.Your thoughts on this please Loretta0 -
Ignore it's a standard letter1

My thought - ignore their offer.
Please re-read Coupon-mad's 6th February post.1 -
Thanks Guys, just what i was thinking, i would for the extra £60 rather take my chance in court than pay these scammers outright. When this is all over i am going to get an appointment with my mp and put him in the picture.1

Hi Everyone
Just to let you know that after complaining to BP they wrote to the company who run the EM garage and they got VCS parking to drop the case. They had already filed court proceedings so really relieved this is all over given the challenges we all face at the moment re Covid-19. I would have defended my case as I felt so strongly about how unfair this was, but this is definitely a route worth pursuing.
Keep safe.

Somewhere in here i posted the byelaws for the airport site, pushed a little for time at the moment
Just to let you know that after complaining to BP they wrote to the company who run the EM garage and they got VCS parking to drop the case
Make sure you keep any cancellation letters somewhere safe, i wouldnt trust the PPCs any more than i could trust Boris Johnson to give clear and concise information

Good result, notwithstanding what Half_way and Fruitcake have said.2
