Buyer's solicitor failed to register purchase

We recently sold our house and bought a new one, all completed a month ago. Our new property is registered but our solicitor has requested an additional document from us so our buyer's solicitor can register their property (the one we sold). Without the document, they are unable to register. Our solicitor has told us we have no legal obligation to provide the document as their solicitor should have requested it before exchange.

Ordinarily we would provide this no problem but our buyers pulled some particularly nasty tricks on us throughout the entire process and made completion day nothing short of hellish for us. They squeezed extra money out of us for no valid reason and made us pay for the most ridiculous things.

We have the document they need but getting it to the solicitor will prove to be difficult as we work and are both unable to take time off and quite frankly, I'm not keen on going out of my way to do them a favour when they made the whole process so horrendous for us.

BUT what I really want to know is what situation does it leave our buyers in? They are the types to pursue legal action wherever possible (they threatened us with legal action several times, even on completion day) so if we don't provide this documentation, what options do they have? And can it come back on us at any point? Our solicitor isn't being overly forthcoming with additional information so I would appreciate any information! Thanks 😊

    Can you not just post the document?
  • In theory yes, however it's an original document that we will need in future and will need to pay to replace if it goes missing in the post - so aren't willing to take the risk.

    Tell the buyers what your administrative charge will be for providing the document.

    p.s. Their solicitor has made a monumental !!!!-up and any money you extort out of your buyer will be repaid to them by their solicitor from their professional liability insurance. So if you're out to hurt your buyer, you won't.
  • If you will need the document in future, why would you give it to the buyer under any circumstances?

    What is this document?

    If it's a Will or Grant of Probate the buyer's solicitor can buy their own copy online from the relevant official registry.
    A kind word lasts a minute, a skelped erse is sair for a day.

    It will be paid by their lawyers and not their insurers as any amount wi almost certainly be lower than their excess

    In your post #1 you say your buyer needs the document, now you say you will need the same document in the future so are not willing to post it, how come you both need this document if as you say your solicitor advised you are under no obligation to provide the document?

    Dragging matters out a while though will give a certain amount of self satisfaction. Hopefully give the other party food for thought.
