You can respond to the claim form with a defence and a counterclaim, such as for the repairs and costs of work not done and repairing the damaged fence.

moneyclaim is the bulk business centre but once you respond to a defence any hearing will be in a local county court.

It should have a claim number and you can check with the moneyclaim service if its valid
The Money Claim Online Helpdesk can be contacted on 0300 123 1057 / 01604 619402. It does experience a high volume of calls so you may wish to consider emailing your query to ccbc@justice.gov.uk.

in addition the email OP received is from the govt notification service where people who have a loose connection with NHS, local authorities etc can set up an account to send messages see https://www.notifications.service.gov.uk/
  • Hi,

    Thanks for all your reply’s.

Maybe I should call them and quote the claim number I have and get to the bottom of it. Seems very odd as when I google search it. It allows me to log in to view the claim etc and the claim document your able to download as a pdf.

This is on the bottom of the email notification I received

    HM Courts & Tribunals Service

Slanderous is the quote on the claim details and on the heading for the photo evidence.

I thought slander was a spoken word not a written word and am I correct in saying the onus is on the claimant to prove that such comments if proved untrue have provided loss of earnings with proof.

I feel I have a strong case with evidence between us showing I was ignored on 23 occasions when trying to make contact

Also does the claimant have to provide notice of intent to file a claim in such a case to attempt to come to an agreement before they can peruse such action ?

Can anyone help me with these questions at all?

If the "bad review" is factually correct then it's not going to be libel. In any event they would have to back up their stated losses.

Slander - verbal, libel - written. They would have to justify their losses, as davidmcn says. The important thing for you to do is to reply to the form, even if it's to submit a defence. If you don't do this they win by default. They should have sent you a letter before claim, so don't forget to include this in your defence. The court isn't there to give legal advice, so they won't have told the claimant to file for slander. They are supposed to go through ADR (alternative dispute resolution) before going to court anyway, so also mention that you've tried to negotiate with them. You may wish to counter claim if you've paid for work that hasn't been completed or has been botched.

Not sure which section to post this is but here we go.

    Hi,

I had some work completed for me by a landscape company. Now the job wasn’t fully completed however they promised to return 2/3 days later to correct it as it was late in the day. I made the payment by bank transfer (rookie move).

Now they responded to me for the first 2/3 days and to my partner but then totally ignored me and her and all forms of messages on text, Facebook via there business page and calls.

I posted a bad review on a review site and provided them with the proof necessary to do so. I also posted a shared review onto a Facebook community page detailing my dealings with them to warn others.

Fast forward 3 months and a money claim has been made against me stating the fence was damaged after installation however I have a photo from the day of installation showing it in the condition it was left. Also for my ‘slanderous’ quotes that have caused them to loose Business.

What’s my best play here and what are my chances?

    Cheers

Declan - if I were you I'd also try posting on the Consumer Action Group forums here: https://www.consumeractiongroup.co.uk/forum/305-general-legal-issues/

They have a site team who can advise on court procedures for people representing themselves.

You'll need to provide detail of: (1) what happened; (2) what you've done; and (3) what you've received, from whom, and when you received it.

They'll probably also ask you what you haven't received! (Do you have any history or experience of mail going astray?)
