Private PCN - Excel Parking - WE WON!

Hey guys,


Hope you don't mind me posting this, but I've just appealed my private PCN as due to poor signage and markings my gf parked in what she thought was a bay, paid the parking ticket and a few days later received a NTK. Personally I think she has a case but I would like your opinion on things.


Is it worth fighting this all the way?

    Where? Which type of car park? Name of PPC? Do you still have the ticket (that was bought for the car park)? Did you appeal as keeper? Was the PCN addressed to you or your girlfriend?

    We win the vast majority of cases here. I don't see why this one should be any different. Can you confirm which ppc this is?
  • It is issued to my gf. The car park is owned by Excel and they use myparkingcharge.co.uk as a gateway.



    Car park is Woolpack Lane car Park, Nottingham. I have all correspondence and a valid parking ticket. I appealed as the keeper.

    Confused! If it was issued to your gf, why are you appealing it?

    Excel won't own the car park, they merely manage the parking regime. Is it attached to shops or the suchlike?

  • She has asked me to appeal it with her. I basically wrote the appeal for her with advice from this board, but if it's rejected I wanted to know if it would be worth taking it all the way based on the reason the ticket was issued. I have photos to show what the charge was for, based on that you could give me an idea if it would be worth going to court if it got to that stage.


    The Excel car park isn't attached to shops. It is a small bit of land they turned into a carpark. Only like 8 bays.

    To upload a photo/scan link, you first need to host it on a free photo hosting site (like Dropbox, Imurg or Tinypic), copy the URL, paste it here, but change the http to hxxp and we'll do the conversion. Newbies can't directly upload links to photos/scans until they've a few posts under their belt.

    It is always worth defending and it is YOUR case to defend, if you are the registered keeper and chose not to name her as the driver (keep it that way).

    Like we said read the NEWBIES thread, no IAS stage, no further appeal.

    Come back when you get a claim, as this is where such cases are won.

    [FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
