hi all,
the POPLA decision was declined so was told to pay £100 by 28 days of the date of the letter.
"failure to pay the full amount due within twenty-eight days will result in the amount outstanding being referred to our debt recovery agent. if necessary, the amount payable will increase to £160.00, in accordance with the terms and conditions of the parking that were explained clearly on our signage"
1. do i get a few days grace from the date of the letter? 5 days late...
2. on the paycharge portal, the charge is £170.00 - is this right??
thank you

Debt collector fees have now been added on , ignore
If you really want to pay the £100 , complain to the BPA that you haven't been able to pay the £1000 -
Wthout any background infomration on why your vehicle received a parking charge, and where its impossible to offer any useful advie on how to put a stop to this nonsense, other than dont payFrom the Plain Language Commission:

i apparently stayed parked up for more than 3 hours which wasn't true.
the retail park was visited on more than one occasion that day.
i only got 2 pictures arriving and leaving but none for the other occasions which would have proven that the car wasn't there for over 3 hours.0 -
So a 'double dip' then. Did your POPLA appeal make that clear, in line with the advice on this forum?
Why even consider paying? Yes, the prospect of sitting out disgusting debt collectors' letters and then possibly preparing for a court appearance may seem daunting or annoying at the very least, but I assume that a well-prepared case would have a very good chance indeed of winning.
Check out other UKPC 'double-dip' court threads.
And if you provided evidence of what happened to POPLA and argued correctly then definitely complain to the BPA. In fact, complain to them even if you didn't do this by the book .... we all make mistakes. But UKPC's 'mistake' is so, so convenient for their bank account, double-dips shouldn't happen - but they do, again & again.0 -
Yes it's called double dip, ANPR isn't fit for purpose the software only seems to work for twin events, e.g. if a first out isn't recorded, the second in is ignored (as if the system defaults to thinking that the VRN is still on site) and only the first in and second out are recorded.
Local authorities are banned from using this system because of it's inerrant failings and unreliability.
If you just used your appeal to POPLA that you used to the scammers (and UKPC are renown for scamming) you were bound to fail.
You will now have to wait up to six years and see if they try a punt at court, debt collectors can't UKPC can.
Do you have any proof that the car was elsewhere during the period it was off site?
Why would you be considering paying a known scam, by known scammers (they have been suspended in the past for doctoring evidence), and your certainly should not be paying the inflated debt collectors phony charges on top.0 -

no, we went to another store nearby to check prices then revisited the first retail park. Why would you be considering paying a known scam
their last letter seemed very convincing0 -

Have you asked the shop or retail park manager to cancel it?
no, i didn't think they would entertain that request because they must have had complaints before and if they were bothered, they would have removed UKPC from their property..
i will try though ...., thanks0 -
Where is this retail park? some places have a habit of cropping up more frequently than others.
As above this on here and other parking/consumer sites is known as a double dip, elsewhere its known as two visits counted as one.
Under no circumstances should you consider paying a penny of this, as its entirely down to the flawed systems in place at that site ( how many others will have been in the same situation/will be??)
A simple complaint to UKPC should set things in motion, something along the lines of....
To whoever at UKPC, re parking charge #xxxxxx
Notice of unauthorised access and processing of personal data.
I am the registered keeper of vehicle (reg number)
The vehicle was not in the car park for the times you allege, you appear to be relying on an automated system without taking reasonable measures to ensure that the data you gather is accurate ( a key part of the GDPR regulations) such reasonable measures could involve an employee paroling the car park checking the ANPR data for overstaying vehicles is accurate, combined with live monitoring of camera systems.
If such measures were in place then this incident wouldn't have occurred.
You are now required to remove my personal data from your systems, (with the exception of replying to this), and remove your flawed camera systems form the site
And as for the site owner/finding out where the site is, this is important as they will be jointly and severally liable for the actions of their agents ( the parking company)From the Plain Language Commission:
