stuck in queue cars merging ..i was in the right lane.. car in the left lane made inappropriate gesture and i let her pass me ...she went past and hit the brakes intentionally to cause a minor collision ...police was called in ...i was in the back car...told police everything...insurance said even though it could be my fault but they can fight it based on drivers behavior as witness are also available...few days have passed no claim from other side yet..

please advise.

You have reported it to the police and your insurers. There is nothing else you can do except wait.
  • I'm not sure what advice anyone can give. You've already done everything you can do. If the witnesses corroborate your story you may not be held at fault. If they don't, you will likely be considered to be to blame.

I've no idea. What did you do that makes you think you'll get penalty points?

??? It was a minor collision. Unless the car is not legal or safe to drive (eg. Lights broken) then why shouldn't it be driven?

because it did end up two cars in contact accidentally off course ...how would DVLA see this...
  • You dont get points for an accident unless the police prosecute you for driving without due care and attention.

Despite what you may think, the other driver could claim a dog/cat/child ran out in front of them. Almost always when you hit the back of a vehicle in front, it is your fault for not keeping a safe distance.

Have the police said they are going to prosecute you? If not, no points. Your insurance & no claims is another matter.

    Nothing to do with DVLA.
Only the courts (or the police, if you agree) can award points. DVLA simply record the.

how long does it take before police notice is received? if one issued..they had dash which should opt out if there was an obstruction in from of them...

wishing to harm someone and actually causing harm to someone should be treated differently ...rather someone was at front and braking distance was not maintained...
