CPR31.14 doesnt apply to claims onthe small claims track, so no.
Youre asking for documents to help narrow the issues of dispute, as is expected of both parties. To refuse your request is unreasonable.0 -
Submit a SAR by e-mail with proof, i.e. copy of V5C asking for all data pertaining to you under the terms of the GDPR.0

Hi... I did send the SAR to CPM. Do I need to send the gladstones any letter? Please advice. Thanks.0
-
The SAR goes to UKCPM they are the ones who hold personal data on you.0
-
Yes I did send the SAR to UKCPM but on NEWBIES thread it say to send a letter to the solicitor as well?0
-
Do so if you feel it's necessary0

Hi..Do you think I have a chance on the argument that CPM issued the PCN at location wellington place, wellington way E3 4XL but there is no place called wellington place on wellington way?0
-
It means they have failed to specify the relevant land, so that is a POFA argument. If the driver was revealed (I dont know) then that doesnt help, as with a known driver they have no need to follow POFA.0

Yes I was the driver although I dont live there. I also took Coupon-Mad's wording to write a letter to Gladstones. Please could you guys check if this is ok to send? Shall I just email this to their inquiries email or post royal mail 1st class. The letter as follows:
Name & Adress
Gladstones Solicitors Limited
The Terrace, High Legh Park
Warrington Road, High Legh
WA 16 6AA
Date:
Dear Ms XXXXX
Claim Number: XXXXXX
On xx/xx/xxxx I received a County Court claim from yourselves of which I have acknowledged receipt indicating my intention to defend in full.
I would like to inform you that I have sent a Subject Access Request to your client UK Car Park Management Limited (CPM) on 18th November 2019.
I want to know the breakdown of the £160 which mentioned on the claim form and the evidence relating why your client is pursuing a case that involves parking on the public highway operated by Toer Hamlets Council, where issuing a private parking charge would be illegal?
Just to let you know that I will be filing a defence which deals with the meritless claim in detail, and in evidence at the later stages, I will be including the two statute laws and one binding case law that defeated BW Legal's barrister in the application they lost at Southampton County Court on 11.07.19, a decision that will surely debar any future 'parking firm' claim in that circuit at least, from trying to add 'costs' that are indisputably already absorbed in the parking charge itself. Perhaps you would like the same result for Gladstones that has stung BW Legal, but in a different court circuit? I will be glad to oblige.
Kind regards
