Tesco cc & thomas cook section 75

Hello I've looked through threads but can't find any one in the same situation as us.

We booked flights (flight only) with Thomas Cook to fly out on the 22./9/19 and return on 3/10/19. We managed to fly out on the last TC flight to Lanzarote 22/9/19 landing at approx 7.30pm. We found out at approx midnight same day that Thomas Cook had gone bust so immediately booked a return flight with Jet2 for the 3/10/19. This was before it was announced that flight only would be repatriated as well as flights covered by atol.
We have tried to claim the cost of the Thomas cook return flight on 3/10/19 under section 75 but Tesco credit card have refused saying we should have come back on the repatriation flight.
Could any one tell me whether we do have a case to claim for the TC flight that didn't happen due to them going bust please? We aren't trying to claim for the cost of the Jet2 flight.

    Yes, you have a claim for the return flight. But it is not S75 you are looking at.
    You are looking at a straight chargeback for the partial amount on a non reciept basis.
    So you will need a breakdown that shows the return flight cost.
    Then ring your card provider and ask to speak to the disputes team about this.

    Thank you for your quick replies. I do not have a breakdown cost of the return flight, only the total cost of the flights on the invoice. So I think I am stuck. Never mind. Thank you again. x

    Not having the breakdown isn’t a problem, the full amount could be disputed to allow Thomas Cooks bank and Tesco to work out what the breakdown was between them.

    It’s the fact you could have flown home for free that’s the issue at present.

    You jumped the gun IMO - if you had waited for news you would have come home for no extra cost.

    I would have done exactly the same in the OP's situation. On hearing the news, I would have assumed the worst-case scenario that all the alternative return flights would quickly get booked up, and would have booked seats straight away to make certain I could get home, and then sort out the fallout afterwards. I can totally empathise.

    That was not a known option on flight only. It was only covered that package holidays would be covered for repatriation.
    So Yes we would start a chargeback on the return flight. But would require the breakdown of cost.
    That is one of the required elements of a partial chargeback.

    Have you been doing these then? There’s not been any distinction between flight only and package being repatriated, everyone was, same as Monarch was.

    Do you have any info on representments regarding these chargebacks? Would be good to know.

    Also, can’t you do a full chargeback on the basis there’s no breakdown for a partial and let the merchant bank respond with one. We would do this with Visa and Mastercard claims (from memory you are primarily Visa).

    I would personally expect Tesco Bank to either refund the cost of the replacements via S75 obligations or refund via chargeback.

    The OP didn't act unreasonably by making alternative arrangements once TC Airlines was unable to provide the service as ATOL doesn't usually cover flight only bookings.

    Ultimately, the service wasn't provided and the OP got lucky that a repatriation flight was made available at my (taxpayer) cost .

    Yes there is such a thing as a partial chargeback. The 'all or nothing' thing is another of those pieces of false information so often repeated on these forums.
