ParkingEye Appeal to POPLA (6 Beaconsfield Road, Southall)

Reaching out to experienced members on this site for a review of my draft appeal to POPLA in regards to an alleged 16 minute parking infringement that occurred on 29/09/19 in the PrivateEye Car Park at 6 Beaconsfiled Road, Southall following some shopping at the main store served by this parking facility.

The driver lives 16 miles away and was on this sight for the first time and so was unaware of the terms of use of this parking facility and did not see the signs and they were not prominent or clear, the driver was not intending to park but just to collect the shopper and the weather was extremely poor.

The PCN was sent to the owner within the required time frame. An internal appeal was lodged with ParkingEye who rejected it without responding to any of the points made and evidence sought.

I will try to submit my draft appeal here in the hope of obtaining a once over from those that are in the know and crucially because PrivateEye (and its likes) are committing daylight robbery at the expense of genuine unsuspecting shoppers who are not aware of the trap that they have inadvertently driven into.

  • Unfortunately after 4 years of being registered on this site, when I try to port a link to my draft appeal I get an error message saying I'm too new!!!

    I have spent a lot of time inserting all the proofs and then hiding the personal info. Is there a quick way of me uploading the link to my draft appeal document here or shall I just proceed with submitting to POPLA without any further delay?

    PE signs leave much to be desired. Many judges might find them insufficiently clear to form a contract, read this;

    Blimey, that's a chunky appeal! I suspect that some of it is not entirely relevant, I haven't read every word. I very much like the photo showing graffiti. First impression is good though - you certainly mean business!

    One thing that strikes me is that you should make a lot more of the grace periods. Current advice on here is to very definitely split them into 2 parts. Post 15 on this thread shows exactly how to do this and although you need to check it carefully, I think the quoted example is good to go as it is:

    Have you tried for a landowner cancellation? You have the support of the shopkeeper, can they not cancel it? If they don't have the authority, they could direct you to the landowner or land management company that will have. Pursue this route in addition to compiling your POPLA appeal. It's best to get a landowner to cancel before the appeal is submitted, if at all possible.

    Regarding the landowner, I did try to peruse that path the shop owner declined to give me full details of who the land owner was......

    ...OK, so I know of part of his name and have done some more research and got a full name for him with an registered address but no phone number or email. He is a big shot businessman. Let's see where I can go with that.

    Seems to me that sometimes the big shots are the most helpful. I suppose they have assistants who can do the admin for them if they do agree to cancel!
