    Thank you! Such a weight off as we're looking to re-mortgage early next year and that would not have been favourable on my record!
    So the Judge said he assumed I'd be keeping the same defence as in my draft to which I replied I would be. I'll definitely take a look at the other examples to see what else I can add to it as well that'll help my case. Do I need to amend my witness statement and draft order and take out the stuff pertaining to the set aside or shall I keep that in?

    Your Witness Statement will be something entirely different. It will be contesting the Claim, not justifying a set aside.

    Similarly, that Draft Order, or indeed any Draft Order, plays no part in contesting the underlying claim.

    Write a new WS like all the other ones about primacy of contract, and append Jopson v Homeguard, Pace v Noor, Link v Parkinson, etc.  plus the Southampton case about falsely adding £60, plus all the usual stuff used in UKCPM cases about Jack Chapman signatures if you (eventually) get a WS about that...

    Hooray that you got your costs awarded too, nicely done!

    The witness statement *now* is about defending the claim. Nothing to do with teh set aside - thats done. Same name but different subject. 
    Dont forget its also the time to append documents that support your WS and defence, so if you state primacy of contract you have to include the lease.

    So I sent all my documents off to the court and Gladstones, and I've received a letter from Gladstones today. It contains their Directions Questionnaire and states that the Claimant has elected to mediate without the need for further court intervention. Any advice on my next move would be great! Do I agree to this or not? Thanks so much in advance.
