BW Legal Letter of Claim Received
rockertom11
I have received a Letter of Claim from BW Legal in relation to a PCN from summer 2019. They are requesting: £160 for principal debt and legal costs.
Essentially, a car park was driven into in my vehicle and parked in, the signs were not clear at all and the writing on the signs was in tiny print. There was no suggestion upon entering the car park that charges applied 24/7 and if there was in the dim light there was no way the tiny sign would have been visible. I understand that most cases similar to this are easily defended. I have been written to as the keeper via NKP previously.
I have read the newbies thread and made a SAR to the Parking company and am writing to BW Legal to request a pause until the SAR is complied with.
I may be leaving the country in January (travelling) so I am not sure how I will be able to attend a Court date as it is unlikely it will have occurred prior to then.
I will update this thread as the case continues.
Any advice much appreciated.

BWLegal have added a fake £60 scam amount
BWLEGAL CANNOT MAKE UP THEIR MIND ???
*** LEGAL COSTS
*** CONTRACTUAL CHARGE
*** DEBT COLLECTOR CHARGES
*** ADMIN COSTS
All of which is complete rubbish and the courts call it ABUSE OF PROCESS ..... READ ABOUT ABUSE OF PROCESS
Abuse of Process ... District Judge tells BWLegal

It's a scam rockertom11.
When you respond, ask them on what authority do they have adding on a fake £60 ??? A judge will be interested in whatever feeble excuse they come up with0 -

The legal costs are included in the £100, they are trying t claim them twice. Read this

Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
I wouldn't have asked for a pause then. The inevitable claim will arrive just at the wrong time, I am guessing.I may be leaving the country in January (travelling) so I am not sure how I will be able to attend a Court date as it is unlikely it will have occurred prior to then.
Can you give a foreign address for service now. I would, RIGHT NOW. Or are you travelling such that there is no-one's foreign address you can give?
You will need someone to be opening your post who will NOT panic when it includes a claim form. So start thinking how to handle this, unless you can get the landowner/retail to cancel it by really rattling their case (3 times, it seems to take, before some landowners will call the dogs off and get a PCN cancelled).
You have not said who the claimant firm is, and it's not BW Legal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The claimant firm is Armtrac. How would I rattle the landowner case?
I have revisited the car park and the signs were very small and at ground level when entering the car park. The writing is in tiny print. I have photos of this.0 -

And in the small print it mentions an extra charge, which nobody can read whilst in a moving car
Judges are getting rid of the fake claims from BWLegal due to abuse of process0 -
Read this thread wrt poor signs.
PE signs leave much to be desired. Many judges might find them insufficiently clear to form a contract, read this;
