Keep checking with the court to see if the case is still on. Turn up unless you get something in writing from your court to the contrary. Don't rely on anything from the scammers, only from the court.
Don't forget to send your costs schedule in time and have a copy to hand if the case is still going to be heard.
You may still have time to make a counterclaim for DPA/GDPR breach. Alternatively you can make your own claim in the next six years. The scammers obtained your details from the DVLA without justification so that is both a data breach and a KADOE contract breach. Discontinuance or court win, you should complain to the DVLA and ICO about this.

You normally (i.e. in normal times) hand your WS, evidence and summary cost assessment in a tabbed and indexed ring binder. Given the lock-down, can you find a good reason for going out, i.e. is it ESSENTIAL? You post to the claimant (or e-mail if they permit it) by normal post with a free certificate of posting (again, given the lock-down, how does one get to a post office?) Thanks guys. Just got this from Planning Enforcement:
"Dear XX,
I write with reference to your recent enquiry regarding the signage, cctv at the Berkley Precinct car park.
The matter has been investigated and it has been determined that advertisement consent is required for the signs erected within the car park. I have informed the Management Company to submit an application to regularise this.However, please note that if no application is submitted then the Planning Service will not be taking any further action regarding this matter. The reason for this is that these signs in the context of the character of the areas (private car park within a local shopping area) do not have an adverse impact on the street and do not cause any significant harm and therefore not expedient to take any further enforcement action regarding this matter.
Please note that enforcement action is discretionary and government guidance is such that enforcement action should not be taken where little or no significant harm is being caused. We should not be taking action just because a breach has occurred. In this case we have carried out an assessment and found that it is not expedient to take further action for the reasons given.
With regards to the ANPR (CTTV) cameras these are classed as being de-minimus meaning that they are not significant enough to consider as development and therefore do not require planning permission.
I hope this clarifies the planning situation.

Another wimpy council who refuse to take action about a scammer.
However, advertising consent cannot be approved retrospectively.
If you do get your day in court then do say that advertising consent did not exist at the material time, cannot be applied retrospectively, not having it IS a criminal offence even if the council decide not to take action, therefore the claim was illegally issued, or words to that effect.

So received the 61 page VCS package in the post today.....3 weeks early!! Wonder if it's related to that Planning Enforcement email we got 2 days ago?? Anyhoo, don't have a scanner, so will have to type the thing out in sections. Any advice on whether to start with typing out the WS or the Service Agreement (Car Park Management) with Lambert Smith Hampton? Cheers.0
