This is what the Prankster says about Albert Street.
"Either the landowner has a contract with Excel, in which case the notice to keeper is not valid as it arrives from a company who does not have the right to manage the car park. Or the landowner has a contract with VCS, in which case, VCS does not have a contract with the motorist because their name is not on the signage."

RobinofLoxley said:Also it might be worth putting in your supplementary W.S. if you haven't already mentioned it in your original W.S. the fact that the P&D tickets issued by the machines are clearly in the name of Excel. If you don't have one, I can provide an image of a ticket for you.
And thanks everyone else, will be doing the SWS in next couple of days.3 -
First draft email to landowner. Advice appreciated on tone
"Dear Mr Barraclough
I am writing to request that a court case be dropped against my husband XX, by the scam parking company Vehicle Control Services Ltd. They are claiming £185 for parking at the Tesco car park at the Berkely centre for ‘breach of contract’ that has never existed. The court reference is XX.
Mr Barraclough, I am curious as to what you think about VCS issuing claims on your land when it is managed and operated by Excel Parking Services?
Either you have a contract with Excel, in which case the notice to keeper is not valid as it arrives from a company who does not have the right to manage the car park. Or you have a contract with VCS, in which case, VCS does not have a contract with the motorist because their name is not on the signage.
Please speak to VCSL and get this fake claim struck out immediately.
I look forward to your prompt response.
Yours sincerely"

No need for a full stop and a capital letter, it is a classic either/or situation!

I would change VCSL to VCS Ltd. You might also want to clarify the fact that UK MPs across all parties have referred to private parking companies like these as scammers, rogues and bloodsuckers in open parliament. *
* Other endearing comments by our MPs are available.

I would remove the scam from the first line ... that's what we think about them but it doesn't really put you in a good light when writing to a landowner. The sentence about UK MPs covers this nicely.5

Email reply from Greg Barraclough today:
"Dear XX,Thank you for your email, the contents of which are noted.
I can further advise that this particular matter has been brought to my attention by MP Olivia Blake and I replied to her on 5th June.
In respect of the contract, as you correctly state there is a contract in place with Excel Parking Services to operate car parking restrictions at Berkeley Precinct. Visitors to the site are advised of their instruction and the restrictions that are in place across the site via the signage posted.
With regards to the enforcement notice having being issued by VCS Ltd, I understand that VCS Ltd are part of Excel and are who their notices are typically issued by. The validity of the notice is not for me to comment on or determine , though I have cc’d Jake Burgess, Legal Executive for Excel – who should be able to clarify further.
Kind regards
Greg"
