Thanks Redx, it's easy to forget sometimes - at least that it something I do well - forget!  I have edited my post in case other posters ever come across it.

Ok nearly there, last question point 16. in the defence template from Coupon-mad(thank you) about compliant NTK, as it was a hire van do I keep this point. Also do I mention here any POFA non-compliance section 13 regarding Hire vehicles, ie they sent the hire notification to me  52 days after the initial 'contravention' date & no hire agreement documentation included either with the hirer notification letter.  Even though Excel are non compliant with POFA it appears(no mention anywhere of POFA in letters).

You know that this is unlikely to get in front of a judge for months, if at all, read this,

I know I just need to get my defence in by 4pm today, trust me I'm a health professional &  I have much better things to do at 2am in the morning but i refuse to let Excel win this stupid case. I just want to make sure i'm entering a proper defence from the template. Cheers

In the present circumstances that is becoming increasing unlikely,.  Indeed, I predict that few of them will come out smiling at the end of this.

Would it not be Notice to Hirer, although you were the day-to-day keeper.  Do not miss deadlines!

If it's a hire vehicle you got a NOTICE TO HIRER.

Replace any and all instances with this, and obviously point out pofa non compliance.

Basically it was a hire van - Excel are non-POFA compliant, but sent notification to hirer late (52 days) wanted to make note of it even though they are non compliant section 13 etc, so in point 16 i change it to Notification To Hire or leave as NTK. Plus we paid via connect plus app & have Comp bank account showing payment to Excel. Never gave them my name but i was the hirer on behalf of the company...So do u give up the driver name or not, due to non POFA?
