OK i thought this was paper, and not in the hearing.
So when you raised that the Order you had dated June .. .said to send by... and you did so, what did they say?
You realise were not even seeing half the picture here? You've given us a really incomplete telling of whats happened.2 -
Im confused why you said you misread and thought it was late!?
Show us the actual Order(s) from the court setting out when you had to file by. Need to see those to have any clue.3 -
I received one order dated 5th march (although at the end it's dated 11th Feb.)nosferatu1001 said:Im confused why you said you misread and thought it was late!?

And one order dated 15th June.
I sent my WS more than 3 days before the hearing date (4th August) as requested in the order on 15th June.
Hopefully I've redacted enough. If you need me to remove any redactions please just let me know.
Thank you.0 -
What did you say about th3 June order?
nothing in the June order overrides the April order, to my reading, so you were late by months.0 -
8c says to email documents to the court at least 3 days before the hearing.0

I'm not the expert in this, but you could try a last ditch attempt to persuade the Judge to vary the order given the stop-start nature of this, lockdown, the uncertainty about whether it would be a face to face hearing, by video link, telephone or on the papers, the confusion over the dates of the first court order March/February, the second order suggesting papers to be submitted 3 days prior to hearing date. Lay it on thick ...... and hope for the best.If no joy, pay it by the required date to avoid a credit-trashing CCJ. Don't pay in instalments as that still trashes your credit-worthiness.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you. How do I go about doing that? Should I contact the court directly or is there a specific way to do this?Umkomaas said:I'm not the expert in this, but you could try a last ditch attempt to persuade the Judge to vary the order given the stop-start nature of this, lockdown, the uncertainty about whether it would be a face to face hearing, by video link, telephone or on the papers, the confusion over the dates of the first court order March/February, the second order suggesting papers to be submitted 3 days prior to hearing date. Send an e-mail addressed to the judge at the court in the judgment/order.1

Disaster. As my WS had not been filed in time* Judge struck out my defence and awarded full claim and costs to claimant. Over £400. Any experience of whether/how to appeal?Hang on. You attended a hearing by phone on 4th? And lost?
Or you let this be heard on the papers (not what you would have got from us!).
Was this about one parking charge?
How is the £400 made up?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

shen. You. Told. The. Court. About. The. June. Order, what. Did. The. Court. Say?
the June order does not override the previous order, not explicitly. It can b e read that it does, but it doesn't actually do so. I know what the orders say, this is my opinion based on the 8c wording not using serve and so does not allow you to ignore the requirement to serve.1
