Hi all - I am embroiled in a "double dip" charge and the parking co. VCS are not listening - claim nearly 10 hours in a 2 hour free car park.
I am in contact with land owner's agent who seems to not know how the parking scammers work and expects them to respond to his questions.
I have just found some logs in my laptop event viewer showing several logon/shutdowns while I was alledged in the car park.
Sent to agent.
What is their evidence value ?
I have just got CC summons - hoping agent stops this mess.
Reading the summons, do the car parking scammers get court fees back if case doesn't go to hearing ??

A summons?? Are you sure?
It sounds like you may have received a County Court Claim Form. Is that right?
If so, please tell us the Issue Date on that Claim Form.0 -

@beamerguy - do you mean as far as a court hearing or not quite that far?

As it is a hopeless case for VCS (double dip) nip the scam in the bud RIGHT NOW.
Fire an email to VCS reminding them about that - if they've already been told about the double dip, tell them ONE MORE TIME - and warning them you are about to counter-claim for £500 damages as compensation for harassment and abuse of your DVLA data with no reasonable cause (at all) and no landowner authority or legitimate interest.
Head it up WITHOUT PREJUDICE SAVE AS TO COSTS.
Tell them they have seven days to withdraw the claim with both parties walking away without costs, after which (if they do not accept this one-off offer) your AOS will go in and you will file & serve a robust defence and the £500 counter-claim, since this is a known ANPR flaw and they have failed to check their images for the other out/in images of a double visit. Clearly the claim is vexatious and doomed, tell them.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have given an online AOS yesterday.
That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence could be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

I agree with CM that a counter claim is the way to go. There is absolutely no way that they can win if things are as you say. However, if you do counter-claim £500 seems over ambitious to me, perhaps £150- £200 might be more likely to succeed.
[FONT=Times New Roman, serif]Nine times out of ten of these tickets are scams so consider complaining to your MP, it can cause the scammer extra work.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Well yesterday I got an email from the Savills director saying
"success at last -cancelled" - I didn't read it untill early evening.
I guess I have to check with the court to be certain.
No other communications . I thanked him by return email .
Wait and see for now ?0 -
