Please help UK car park charge / Trace debt

Hi

I had a parking charge for parking in a private Street in Plymouth
where my girlfriend lives and parked there for over 12 months with no issues and is awkward down there for parking and have good relationships with neighbours ..

Our drive way has been blocked multiple times with builders been parked opposite us which we are unable to get out but gets resolved

How ever there is no double yellow lines etc outside and a tiny sign along the fence say private road , ...

I will upload the pics I've received and out rage I e received a parking fine over 7 week later ..what the hell is that all about , I was so confused I thought it was a joke and have ignored it .

2 letters in total now from 60 to now 100 pounds when I've done nothing wrong ??

I believe it's a neighbour that's done this for a reason of me having my bumper in line with his wall ..? I'm not blocking anyone in and if need be will move .
With students moving at the time there are family's moving people in and out ?

Now a company called trace have sent me a letter saying I owe 160 ish pounds or I'm having a CCJ and fines etc ...

I've rang them and said what have I done wrong ! He said I don't know and I feel for you buddy . I've asked how do I appeal ?

His response was there is no appeal and if I don't pay the fine will be on going .

It all sounds a bit iffy to me
And to send me a fine nearly 2 months later what's that all about is that even possible ?

    It's just UKCPM like all the other UKCPM cases.

    Read some and the NEWBIES THREAD post #2 about pre-court letters and SARs and be ready to win in court in 2020.

    No paying it, we are here to help you beat it in court in the end.

    The only thing you MUST do now, asap, is remove your old address completely:

    - STOP RINGING SCAMMERS (promise us you will not ring them again)

    - send Trace and UKCPM an email telling them to RECTIFY your address data to the new one located by Trace, and ERASE the old address from the database.

    You know, using the email addy you find when you Google UKCPM Privacy (as the NEWBIES thread tells you in the section about data & SARs).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    So I've been reading and my trace letter is just a debt collector asking for payment and not a claim before court I assume that much so far ..

    And CPM UK car park management has the IPC member stamp on there .
    So the appeal process for this is to send this template back to trace and CPM by email and telling them to remove my data you say ..

    Just making sure I'm on the right track and I don't like having court action etc threatened against me whist I'm going for a new home (gulp)

    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

    - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.

    - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.

    Formal note:
    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

    Well, is your car registered at an old address and the first letter went there, then TRACE found your new address, explaining the delay?

    If so, then add to your appeal, a paragraph confirming your CORRECT address for service and telling UKCPM to erase (use that word) your old address data.

    The case will not be cancelled and you can win it in court next year, so get reading of threads regularly and you will see this is what we do here all the time!

    And very important, if an old address is the problem here, you MUST update your car's registered address with the DVLA, and we don't mean your driving licence.

  • No my address is correct , it's my girlfriend's address I was at which I was.parked out side of along with all other cars .

    I think it was the neighbour that reported me ? And I have no idea why it took so long ,so I will go to court and should I send that template as I said yes .

Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Ok I have a copy of the lease about parking and it says nothing about having a permit to park there ..

    What to do next sent.off the email saying what I drafted above Trace said I had to pay by 1st November before it goes further ?
    I'm awaiting a reply.to find out more about parking from landlord
