Police fine - using phone

    Well as I said that's what people said they were attending for . It was on an business park though - possibly from Greater Manchester Police as the courses aren't police force specific??
    Good point. They could have been from any force in E and W except Dorset.

    Too many useful replies for me to respond to directly, but heres a reply to the general theme of questions.

    1) I responded to their initial letter which asked if I was the driver. It was a Zipcar (an hourly charged car rental service), so it's clear it was me. I also remember being in the area where the alleged incident occurred as I was visiting in-laws.

    2) I could ask for evidence, but I'm sure they'd deny showing it before they were legally compelled to do so, in which case, it'd be a waste of time i suppose.

    Anyone think I should risk denying that the contravention occurred and seeing how it plays out? Technically I have no idea if it's true, so it seems very defeatist for me to just accept the points and pay up in absolute trust of the Met police, the technology they use and the admin/operator staff.

    Any further thoughts? Thanks for your feedback so far everyone.

    Sounds like you may have committed the offence given you're not certain you didn't.

    Six points and £200 may be your best option.

    One of the two is a police officer. The other mutters something under their breath about "well, it's not impossible, but I don't actually recall for definite..."

    Fine. Go to court. But you really are going to have to be absolutely convincing. "I don't remember doing so" is about on a par with "The dog ate my homework, miss".

    I'm really not sure what you want us to say.

    You've replied to the s172 to say "Yup, t'was me."

    You haven't said how long ago it was... But the fact it was a rental has introduced a delay in the procedure to date - they had 14 days to send to the keeper, who may be a lease firm before Zipcar. Each step has a max 28 days, so it could have been early August and still be within time.

    Offence -> (14 day) -> Lease -> (28 day) -> Zipcar -> (28 day) -> You

    It's going to be very hard to be credible when you say "No, definitely not..." unless you can hand-on-heart swear "I would never ever even think of doing such a thing because as a matter of routine I keep my phone in my bag/jacket/whatever in the boot" - and it doesn't sound like you can.
