UKPC left site

Hi
This is my first run in with a PPC for many years - UKPC specifically.


Driver went to a retail park, briefly left & returned to find a windscreen "left site" ticket.


Have read the sticky about the day 26 appeal tactic that will be done in due course.


Question is, do UKPC do court for the highly speculative ones, when the appeals process is followed or do they save the big guns for bigger cases & 'ignorers'. I do know they are dodgy having had bans previously.

    UKPC do court but whether they will or not depends on what you do. You sound like you know what you are doing so that is in your favour and hopefully you will kill this at PoPLA.

    It is extremely difficult for a scammer to prove a "left site" case. Get pics of the site and signage as soon as possible to support your case. Not having a map or description of the site boundary will be one of your strongest points.
    Use all the other points available as well, but don't forget to make a landowner complaint first, and a complaint to your MP about this unregulated scam.

    That said, I have new information since my OP. The UKPC ticketing goon has got the reg number wrong, it seems the vehicle is 3 years older on the ticket.

    This would lead to the question - to appeal or not to appeal?

    I would say they fail on section 7 of PoFA
    (2)The notice must—
    (a) specify the vehicle,



    So just putting this out there for discussion. I found a case on Legal Beagles like this, they got the reg from the photo of the car after realising their mistake & tried to say the NTK replaced the NTD.

    They gave up in the end.

    There is no need for the question about court, because you will win at POPLA stage, given that UKPC will have no proof of the driver leaving the site. And they might also forget to send you a Notice to Keeper next month too, which gives a defence point that wins for a keeper anyway.

    Search the forum for UKPC left site POPLA and you will find examples that have already won because UKPC can't evidence he allegation. what you don't do is admit to being the driver.

    Please no post asking about their standard begging letter/email fishing for the driver, it's obvious you ignore that and I am constantly amazed that people start thread after thread about it while they are clearly awaiting their POPLA code and do not reply to such fishing drivel!

    UKPC also make this 'mistake' a lot and we wonder if it is deliberate, so that people contact them and blab about being the driver and admit to leaving the site, shooting all their toes off in their excitement to tell UKPC that they think the ticket is 'void' - and then they lose at POPLA by getting it all wrong!

    Search the forum for UKPC wrong VRN. We talked about this only yesterday.

    The driver got one of these from Excel years ago & paid up in a panic. Only to still be hounded by Roxburghe/Graham White (one for the kids). Thankfully they are clued up now.

    Just check where UKPC are in the process right now. Have they ‘sussed’ their error (or were they aware of it all along)?

    Go to their website as if to pay (obviously don’t!) and try it under your real registration and that of the erroneous one. See which one is in the system.

    Even if you don’t appeal on day 26, if you subsequently receive a NtK using the correct VRM, they cannot hold the keeper liable under PoFA as the NtD (windscreen ticket) and the NtK have to record identical information. But that’s for POPLA, not for this stage.

    OK, have just viewed the photos. It's in their system with the wrong reg. number.
    Not much to write home about, a front & back shot, one of the inside god knows why & one of a sign.
    I went back on Saturday myself, parked up, got a drink from B&M & stood watching, he sits in his car watching the pedestrian exit by SCS, then pounces. It could be argued that someone didn't leave the site as SCS have a window display at the side which could be mistaken for exiting if you want to have a look, but let's not go there.


    So, should the keeper appeal online? They'd have to enter the wrong reg to do so.
    Or should they wait & see if an NTK arrives once they check the photos then appeal saying they've failed the POFA requirements?


    PS, I left a note on a ticketed car advising it's a scam & pointing them here.

    It is often said they use the wrong VRN as a trap for you to contact them.
    You will know it's a trap if they send you a NTK which can only happen by getting info from the DVLA

    "Driver left site" is part of the UKPC goonery, they are known fraudsters for faking timestamps on pictures
    PROVE THAT ONE UKPC

    I have seen the UKPC goons hanging around car parks, one was rolling up a spliff ....... the low life they employ are just looking forward to their xmas bonus. One thing for sure, they will never win the "Photographer of the year"

    Having searched previous threads it's obvious what their procedure is. Send new NTK, keeper appeals on POFA grounds, a couple of please name the driver letters then a cancellation.


    Are there any grounds to go after them on GDPR grounds, misuse of data? I know the Prankster was keen on this.
