    Even though they have discontinued, can they suddenly open up the case again at a later date? 
    No they can't for that particular parking event. 
    So a win but should I be counterclaiming for the all the wasted time, anxiety and effort they have caused me. 
    There is no 'counterclaim' unless it was filed with your defence, you paid the filing fee and the case progressed to court. You could issue a standalone claim in the county court for harassment (or whatever you want against them), but I'm afraid it's a very high bar to get over - and your chances of success are minimal. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Or they are getting cleverer and actually reviewing the case before the £25 court fees are due to see if there is a chance to win. 

    Thanks a lot for this guys especially Keith, beamer, coupon-mad, umkomaas, fruitcake and a couple of others .. you guys are doing a tremendous community service and I really hope all your efforts are going to close these scammers down.

    That is what I would do, they have wasted your time, now waste theirs.

    has anyone had any sort of success with that here? i dont mind wasting their time if there is some reasonable chance of getting something out of it ... i agree counterclaiming for their ineptitude would hurt them more if people are successful.

    I have not contested a parking claim in court but have won four other cases there.  I would go for it.

    The biggest problem is the way the legal system works.  The roboclaim allows them to look at a WS and decide if they want to proceed.  Of course this is further abuse of the courts and a loophole they can use.
    The Rt Hon Robert Buckland QC is the minister to contact.   This is pure abuse of the public, the courts.
    If a claim is made, monies should be paid at that time

    Thanks guys .. i will try and do both .. write to the MP as a complaint plus try it on with a letter before claim. Would it be to UKPPO or BWlegal ?

    Also D_P_dance, any template you could share for this? if not I will draft something

    Well first youd be sending them a LETTER BEFORE CLAIM as you must give them a chance to settle.
    You might be able to argue data protection violation in which case authority would be Vidal-Hall v Google, which showed that breaching the DPA automatically causes damages, you dont have to show some actual effect.
