People, can we not get into as 20mph enforceability debate. open a new thread if you want to argue backwards and forwards about it.
I am surprised the other cars insurance is going for 50/50. Their driver is clearly driving dangerously, he shouldn't have been doing a double overtake on a single lane road going in hot pursuit of the van.
Whether you swerved or not is beside the point, also why would you swerve and what evidence does he have to suggest that?
Why would you swerve out on a single lane road onto oncoming traffic.

We don't know what exactly the other party has told his insurer. You've based your response purely on the OP's story. If he's said that the OP swerved into him as he was passing then in the absence of other evidence it would likely go 50:50.
If the OP has supporting evidence then he'll likely win.0 -

Can any vehicle reg numbers be seen on the video? (If not then the other party may deny that this video relates to the incident).
You should still use it as evidence though, especially if you can get a statement from the driver of the white van travelling in the opposite direction.0 -

Don't your brakes work? Or your steering wheel? You had plenty of opportunity to avoid that - it almost looks as if you were trying to push him into the oncoming van.

In the two car lengths or more between you both entering the frame and the near-impact, the black car gained about half a car length on you - ~25% further, so if you were doing 20mph (9 metres per second - basically two car lengths per second, or roughly what's visible in the frame), he was doing about ~25% faster, 25ish. The van's doing a similar speed. If anything, you're further right on the road than the van was.
Highway Code stopping distance from 20mph is 12m - 6m thinking, 6m stopping.
Assuming both were doing constant speed, he must have pulled out to pass you at least 20-25m before you both enter the frame. You had PLENTY of time to avoid that getting so close to being a very nasty collision, and the actual outcome is about the least-worst that was possible, more by luck than judgement.0 -

when the white van overtaken me i looked at him thinking #$%$ head but because the black car was tailgating him i never seen him until he hit me and if you watch in slow motion i pull up to the left just as i reach the parked car on the left. i did steer towards the path but if id of gone too far i would of hit the parked car.0 -
Too busy getting irate at the van to look at your mirrors... Even though there's a very strong chance that somebody driving like a prat is probably not doing so in isolation....but because the black car was tailgating him i never seen him until he hit me
And a CCTV camera further down the road would have shown three people doing so - the van, the car chasing him, and the car chasing him... Right?
I'm talking about before impact.and if you watch in slow motion i pull up to the left just as i reach the parked car on the left. i did steer towards the path but if id of gone too far i would of hit the parked car.
Once he's hit you, it's a bit late to try to avoid the impact, isn't it?0
