  • You send to the court AND to the claimant, because the instructions tells you to do so.
You do not send the defence again *unless* the telephone hearing letter you have tells you to compile a complete bundle to send to the court.
Thank you. I've just seen your reply now after sending my latest post.
    I will proceed.

Can confirm I have sent a copy both to the county court and to Excel's Litigation Department.

The hearing is *soon* and I will be updating this thread with any correspondence I receive in the meantime.

Sometimes these video/meet me hearings issue a dedicated e-mail address to which you send your bundle.

The only email I have is from the most recent letter from the County Court themselves (hearings.birmingham.countycourt@justice.gov.uk).

How are these bundles usually delivered to the courts? Printed and posted?
That's the only email I have for them at this stage - I received an automated reply mainly explaining the COVID procedures.
This part is important to note:
    --------------------

HOW DO I LODGE DOCUMENTS FOR MY HEARING?

The preferred option is by email.  Many of the Judges are working remotely and it saves us time in getting documents to them quickly and easily.  Bundles will not be rejected but if they are large,  please send them in 2 or 3 parts.
    ----------------------

I'll assume it's been done correctly based on this

Looks like you have been given the dedicated e-mail address so you are fine.

Most people currently use email, and print nothing.

Hmmm, you mean they failed to serve a WS or evidence to you?  I would phone the court and check it's not been discontinued, and also if it's a phone hearing, to check they have your number.  But just as importantly:

Please now make a real difference - A TASK FOR SEPTEMBER.

The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    https://standardsdevelopment.bsigroup.com/projects/2020-00193#/section

You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/913272/Code_Enforcement_Framework_consultation.pdf

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.

And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Please be heard.  You can bet the hundreds of PPCs will be commenting.

No apologies for repeating this vital 'call for action' to consumers, on every thread this month!

  • No. Excel have sent their WS and evidence to me before. I mean since me sending them my WS.

I'll look into what you have sent.
Are there any threads of people's accounts of these telephone hearings? Getting a bit nervous coming closer to the date.

    Yes, the TELEPHONE HEARINGS thread.

Or, search ANOTHER ONE BITES THE DUST and look for all the winning results over the Summer as they have all been by phone.
