Excel / myparkingcharge Final Demand

Was just reading through the newbie post, so I have a Final Demand letter from Excel Parking.
Parked in a car park, usually as you drive in there's a window where you buy a ticket from a person. However on this occasion it was shut however the car park was open. I've used this car park often so was confused. The ticket is for Failure to display a ticket.

However the charge of £160 is steep for an hour's worth of parking. I'm in a bit of a situation since I'm at University and the letters keep going back to my home address (not going to say where, but let's just say they're 100 miles from each other). I don't regularly come back since my Uni address is where I'm at most of the time. So I've come back to a NTK, Demand for payment and a Final Demand (due very soon)

My main question from the newbie thread is about contacting your local MP. The MP for where the ticket occured is our PM so don't think he's gonna listen to me about a parking charge whilst he's already getting a bollocking from the queen 😂
My local MP is the shadow chancellor, will he have much interest?

(I know I may have inadvertently given away my location but hoping they're too stupid to work it out :))

    If you cannot buy a ticket then there cannot be a contract. No contract equals no breach of contract, read this

    Nine times out of ten of these tickets are scams so consider complaining to your MP, whoever he is, as Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

  • I would like to add, since visiting this car park, I've realised there are machine's to purchase tickets from which replaces the car park window which was previously used.

    So I am technically in the wrong but either way, the cost of the ticket does not justify the loss they would have received. (An empty car park more or less)

    I will read through these posts. Is it worth telling them that my address has changed? My mum doesn't like the letters coming to the house no matter how much I reassure her PPC are scammers. Also I no longer own the car which the ticket is issued to.

    At the moment I've ignored every letter they've sent. I've not even logged into myparkingcharge as I thought that would signal to them I've acknowledged the letter

    When did the car park change its collection method from "little hut" to payment machines? If it is not long, then you might be able to claim that the PPC did not give sufficient notice of the change and also there should be a grace period after removing the window so local users get used to the change.

    Bad decision to ignore (unless they are debt collector letters) you need to deal with it. Unless you want a CCJ by default, you need to advise the DPO of the PPC by e-mail of "your address for service" and require them to "erase any and all previous addresses."

    The Supreme Court says that it does. You need to appeal on other grounds. Read the stickies/FAQs

    The IPC Code of Practice states:-

    "Changes in Operator’s Terms and Conditions

    Where there is any change in the terms and conditions materially affecting the motorist you may place additional (temporary) signage at the entrance making it clear that new terms and conditions/charges apply, such that regular visitors who may be familiar with the old terms
    do not inadvertently incur parking charges. This signage should be in addition to the signage ordinarily required."

  • At the time of this thread, I had emailed my local MP however didn't receive a reply until 6 weeks saying something like sorry your email got quarantined, do you still need assistance?

    I replied saying yes however again have had no reply.

    Today I've received something In a brown envelope so I'm guessing it isn't good (I'm at university, my mum sent me a picture of it so not sure what it is yet)

    Where do I go from here?

    Open the envelope or ask your Mum to do so on your behalf. I am afraid the forum posters cannot see through brown paper!
