    Thank you to you all for getting me this far! I wouldn't have the confidence to do this without all your help!

    I will keep checking MCOL for the defence attachment to show.
    So the next step will be to produce a WS? Or should I await further correspondence from the courts?

  • So I've sent over the DQ to the court via email. Can I email the same DQ to the claimant or does this need to be posted?

    Hi all,
    To update this thread, received a letter in the post today from the county court.
    It states "The claimant, you have been sent Notice of proposed allocation to track which specified the date by which you were required to return the DQ. You have failed to file the DQ with the ccbc by the date specified in the notice"

    It goes onto say how they have 7 days to file it.

    So am I right in saying I've got nothing to worry about here and it's that the claimant (Excel) haven't bothered filing the DQ from their side?

    I sent my DQ by post to Excel (a Sheffield address) and sent the DQ via email (same one as the defence - ccbcaq) to the court.

    Are these kind of letters common?

    Edit: just checked MCOL and the court filed my DQ (albeit 11 days after I had emailed it). The letter I'm referring to in this post comes up as a "general sanctions order"

    I would be worried if I were the claimant and I would be annoyed if I were you because the claimant seems to be getting away with one!  the court issued an order, the claimant failed to comply and what does the court do?  Give them some more time!!!

    This is exactly what I thought at first! Very annoying indeed! As of now they have 5 days so will keep you guys posted!

  • So looks like they've filed their DQ now. However, it seems they have filed it beyond 7 days from the general sanctions order? Or is this the fault of the gov side?
