Asda Parking Charge Notice - ParkingEye

Hello.

I have received parking charge notice (which I think is an invoice and not fine) for parking an extra 30-35 minutes on top of 2hour 30minute limit.

The photo of entrance and exit shown in invoice is not of the parking bay but elsewhere in Asda carpark. Surely the time limit is when we are in the parking bay not going round and round in the carpark to find some space.

That day the car park was very crowded and it took us quite a while to find a parking space.

We have two kids so it take time to take them out and put them in.

We spent considerable time inside Asda. We have a checkout receipt from Asda which is time stamped prior to what the invoice has on exit photo.

It took us a while to load our Asda shopping and then put kids back in and drive off.

Coming out of parking bay was time consuming due to traffic in the car park.

Can we appeal or do we have to pay the fine/invoice? £70 full fine or £40 discounted rate if paid in the next few weeks. Is it worth seeing Asda manager with the receipt?

    It is not a fine.

What happened when the keeper complained to the store manager/CEO?
If that has not yet been done, then do so first. Include copies of receipts/redacted bank/card statements to show how much they will lose when you shop elsewhere if this invoice is not cancelled.

If unsuccessful then read the sticky thread for NEWBIES and send the appeal template in blue text you will find there in post 1. Send it unaltered from the keeper, making sure the deadline is not missed. If it is rejected then read on, especially post 3 of the NEWBIES that deals with PoPLA appeals.
Check the dates and wording of the NTK to see if it complies with the PoFA requirements or not. If the latter then you have a "Golden Ticket" which is a sure fire win at PoPLA as long as the driver's identity is not revealed.

Please also complain to your MP about this unregulated scam.

Parking Eye signs are rubbish, read this

    ccv

Nine times out of ten of these tickets are scams so consider complaining to your MP.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies

Thanks for the guidance and signpost.

Should this complain be done in Asda store (physical discussion) or through their online complaints form? If online, should we wait for reply from Asda before making an appeal?
We will now go an read the NEWBIE form.

If unsuccessful, is this fine something we need to declare in the insurance renewal ?

Quickest would be in person with the store manager, not customer dis-services.
Alternatively direct to the CEO by email.

Yes, wait for the response from Associated Dairies as long as the keeper doesn't miss the initial appeal deadline to parking lie.

What fine? Does your your vehicle insurance company require you to tell them when you get an invoice from a plumber or any other tradesperson?

you could start by asking the manager with proofs of patronage in hand

any failure to cancel, raise a complaint on the head office website for asda (Leeds) because they administer the parking for all sites of theirs

use the website for PE to use the blue text appealing as keeper, on day 26 so you dont lose the 28 day appeal window, but complain FIRST , let asda do the work for now , this is an INVOICE , not a "fine"

this is a civil dispute , nothing to do with insurance companies , its not a criminal offence

Absolutely not, it is not a fine, it is a speculative invoice from an ex clamper for damages for the alleged harm you inflicted on them, a.k.a. a scam.

    - Went to Asda today. Customer service desk phoned their manager who said they will do for one time only but they will record vehicle registration number on their database so we cannot apply for this parking gesture again nationally. The person at customer service desk took the parking charge notice and said they will get this cancelled today. We asked if we will get something in post as confirmation, the person said No.

We are going on holiday later next week for quite some time - so should we assume that this has been taken care of and move on, or is there a way to get confirmation that parking charge notice has been removed?

You should have insisted that they take a copy of it , not take the original PCN

Or you should have copied it and let them keep a copy

It's not cancelled until this is confirmed in writing by parking eye

Only fools make assumptions , so don't be one

    - We did take a photo of the PCN and so we have the reference number.

    - Agreed, so what are my options here?
We wait till Monday evening and then go on portal.parkingeye.co.uk to see what it says against the PCN number? We then go to Asda to discuss again and if nothing comes till we need to go on holiday, we put an appeal on parkingeye website.
