    I will be seeking legal advice but thought id come here meanwhile during the weekend to see if any light will be shed

    Regarding key data detached etc, i dont know. Possibility the accident could have caused the data to stop recording i dont know, but we have evidence of it being on road since.

    I'm afraid forums don't work like that. You don't get to tell people to only tell you what you want to hear, especially when your story is incomplete and downright suspicious.

    No one is going to be able to shed any light on your situation because it's too murky. Get that legal advice and start documenting that evidence you think you have.

    If you have been using the car for that long then surely the mot history will show previous mileage compared to today's plus you must have filled it up a few times so go to your local garage and ask how far back they store their cctv for, it may be that they have you on film.

    It was showing as having insurance and I bet you didn't report it as stolen so I doubt the issue of no insurance would have come up.

    It's unlikely any garage has cctv from August.

    As the car has been stolen, how can they prove what the current mileage shown is?

    The data is usually recorded on the key each time it's used.

    Was it stolen with the everyday key and you handed over the spare key which hasn't been used since the accident?

    This family seem to have a lot of problems keeping track of who owns what car, whether or not they are insured, and who has them at the time. I personally don't know, and have never met, anyone that runs a communal family carpool.

    Cars are written off and repaired privately without evidence (still waiting on the answer as to how the OP paid for the initial repairs as that would be a substantial source of evidence that they happened, if they did).

    I'm not surprised the insurers are refusing to payout.

    That said, the OP is entitled to have his own investigation run on the key, I suppose, and to gather his own witnesses.

    The main keys were both used to drive which were handed to the insurance and they are saying they werent used apparently.
    Garage bill was paid in cash, hence the good deal they done for the repair.

    Insurers use the timestamps from the keys to deny claims, as some people claim their car was stolen at a particular time, and key data shows the keys were used to drive it after the time they said it was stolen. It would appear to be an accepted practice.


    You need to look for concrete irrefutable evidence that the car was in use - parking tickets with the reg number on, an MOT certificate, timestamped security camera footage etc.


    Or you could find out exactly how the timestamping works, to see if you can cast doubt that the clock was right when the keys were timestamped.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
