Insurance Refusing to settle

    They aren't just refusing to settle, they are accusing you of insurance fraud which will most likely go on the MIB database when they also void your policy. Insurance fraud is also a criminal offence.

    Frankly from what you have written OP I haven't got the foggiest idea what to believe. If this is the kind of information you are feeding to the insurers then I am not surprised that they are suspicious. You need proper legal advice and someone who can form a written sentence clearly to represent you.

    If you are telling the truth I really hope this works out for you because you are on the verge of being in a lot more trouble than you appear to realise if you can't get it straightened out.

    That minor service receipt would seem to be your get-out. I assume it matches the car and isn't just a credit card receipt or similar? If I were you I'd head back to that garage to ask them to confirm they carried out a service on the Golf and give you a copy of the service paperwork.

    What dates are we talking about here? When was the accident? When was the car repaired and when was it back on the road before it was stolen in August?

    This is the bit I'm struggling with. Your sibling seems to have very poor judgement skills. So poor, I wouldn't ever have them on my insurance poilcy or anywhere near my car.

    Why I'm struggling with it is him checking online rather than simply asking (particularly when you need to agree to the disclaimer that its not proof it is insured). How did he know he specifically was insured to drive it?

  • As the previous owners insurance was still on the vehicle it showed insured on askMid which is why my sibling thought it would be ok for a quick spin
    What made your sibling think he was insured to drive it? Are you from Bradford?

    Accident was on 02 Jan 2019, back on road 23rd Jan 2019

    Stolen 05 Aug 2019 from outside my house

    My siblings and myself drive each others cars as we are fully comp and covered to do so, he did mention he will take it out when its insured i said its cool, i was at work when he took it out, he honestly thought i insured it already, he regrets it deeply.

    If they want to do me for fraud they will need solid evidence as all they have now is assumptions, oh and some key data which even VW are confused about how its possible

    The car has been on road regularly, fuel receipts I have (dont know how they will confirm this as it dont include reg), also a screenshot of the receipt from the main repair, and a service receipt from february, which the garage can confirm theyve worked on.


    So what were his fine and points for?

    So the car must have been inspected for the damage, subsequently written off and put on database.
    Even if it was repaired the true worth would be substantially less than non damaged. Further to that did you inform insurance of what the car is showing possibly Cat D, many will not insure any way for that reason.


    If its a genuine receipt with date and cost with details of the repair you may stand a remote chance of proving motor was 'repaired' to some extent although not to any insurance companies approval.
    If you havent declared it Cat D even though insurers would know, you wont get a thing for knowingly providing false information for self gain.


    1 in 6 cars on London roads are uninsured!
    Have met 24 year old kids owning Porsche 911 and the like all uninsured because they wont get insurance.

    We didnt even know it was written off by previous insurer until the investigator came to interview us he mentioned it, i have receipts for minor service like brake pads
    Also another garage who done some touch up paint work on it in between who they can confirm with.

    The sibling for fine and points for driving with no insurance when police arrived at scene of accident
