Umkommas - yea information was from mates down the pub hahahaha. I've not had many tickets most were not down to my fault. This one was a blatant overstay. If I got the 100quid fine etc. I'd pay it. 300 not so keen mind.

Thanks the deep I'll read that now.

Got all SAR information, now thanks. Not that it will help overly :)

  • Is there a thread on "when guilty but don't accept the amount of the fine" hahahaha. We will take it to court and under no illusions that I won't lose. Wondering if others had similar experiences
    Thanks

From when is the overstay calculated?
Is it pay nad display> If so is it takimng time of entry to time of exit, and not time of ticket purchase to time of exit? There are TWO gravce periods they MUST apply in play

Did they meet Keeper liabilty compliance? Has the driver been revealed? Who is the defendant - the keeper or the driver? (Even if they are the same person, answer the actual queiton asked, no more)

It is not a fine. We need more information so please answer all questions asked. Do not reveal the driver's identity unless the scammers already know.

You need to provide proof of ID with an SAR request, but not photo' ID. The ICO has said this is unreasonable since the scammers have nothing to compare it with.

Get pics of the site and signage. Pics from 2016 may be available on google street view so have a look in case the entrance/entrance signs are useful to your case. It would be unusual for the google car to enter the car park but they do in some instances, so have a good look.

With a Claim Issue Date of 9th September, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 14th October 2019 to file your Defence.

That's over a week away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
  • Thanks. Yea the overstay was a substantial amount of time :) in all honesty I forgot I even had the car with me but that's irrelevant. It was well over any grace period. Lots of photos and quite clear. I have photos of signage for the SAR.

    Driver has not been disclosed.

Defendant is the keeper. I am acting on her behalf but hasn't been stated.

    Thanks Keith P
