Can you claim compensation for delayed Thos Cook rescue flight?

    And the prize goes to Caz.... this is the relevant paragraph. And in any event the CAA will back the airline’s claims of extraordinary circumstances. Because it is!

    Can’t see any of the NWNF lawyers giving this the light of day either.

    The repatriation operation is focussed on getting people home. Nothing more, nothing less. It doesn’t guarantee the same time, the same airport, or even the same day. People who had booked and payed for long haul premium economy on TCX are having to accept economy on Virgin/BA.

    Talk about first world problems. Be grateful you got home at all.

    Please provide a link to your source of information that states repatriation flights are exempt from EU261 regulations and that all rescue flights are classed as"exceptional circumstances".

    I have searched the CAA site and cannot find anything that states the above.

    I saw a news article which stated the CAA would not be entertaining any claims. When I have a few moments I will find it.

    If you really dont think all these are "exceptional circumstances" though then I give up.

    In this instance, you might think that Thomas Cook delaying your flight by virtue of it going bust was its fault and that its long documented troubles should have been reasonably planned for.

    But even if that argument did wash, compensation claims must be made to the airline, which in Thomas Cook's case has gone into compulsory liquidation and no longer exists.

    The Civil Aviation Authority told This is Money that as you returned on a repatriation flight, you are 'certainly not' entitled to any compensation.

    I know some of the die hard compensationists on this forum seem to think there is no such think as exceptional circumstances and that the airlines are responsible for just about everything.... but seriously, EU261 on a CAA arranged repatriation flight :rotfl:

    A lot of the flights (not all) are being operated on Titan Airways flight numbers as they have been a main player in assisting the CAA. I’d be astounded if Titan hadn’t received some sorting of assurance on this issue from the CAA in advance.... because of the nature of the operation, it was certain not everything would run like clockwork.
