Issues with mobiles.co.uk

I attempted to get a vodafone SIM card through mobiles.co.uk about 1.5 months ago. I signed up and waited and heard nothing, except saw that my card had been charged. I got in touch with mobiles.co.uk and they claimed I had a SIM card. So I told them to cancel the whole thing as I didn't have a SIM card and I had been charged. I requested a refund.

First they said they could not issue a refund. Then they said they'd issue a refund but I'd have to wait for 28 days. Then they said they could not issue a refund but because they have cancelled the SIM for me vodafone will automatically refund in a month.

I never got a refund and now whenever I contact mobiles.co.uk about this they tell me to contact vodafone, when I contact vodafone they tell me to contact mobiles.co.uk.

We are only talking of about £20 and I've spent hours trying to get it back, so it isn't really worth my time. I am quite shocked that UK operators still do this, I am also disappointed that I got the deal because I thought mobiles.co.uk was a reputable site as the deal was advertised on this forum. Now, is there anything I can do when neither is taking responsibility? Can I _easily_ report them to somewhere?

  • Mobiles.co - ruputable? Makes me laugh. CPW is an awful company much of the time.

    Is this a contract? If it is, this will be a monthly charge until it's cleared up.

    Ah yeah. It's a contract but I cancelled it due to not getting the SIM and I cancelled the direct debit. Mobiles.co.uk said the SIM's been disconnected.

    Be careful cancelling Direct Debit. If this is a contract with Vodafone then they may still think you are in minimum term. cancelling may put you in breach and result could be a black market on your credit rating.

    Get everything in writing as to
    what is happening.

    Yep. Vodafone obviously haven't cancelled the contract so now they will end up with a default on their credit file and that stay on there and do them harm for the next 6 years. By cancelling the dd the OP has made a CPW mess much worse and harder to unravel.

    To be clear: the contract was cancelled around 24th of August I think. They sent a SIM card, it never arrived, and as soon as they took the money off my account without me having a SIM I cancelled it. I just wanted a refund on the first payment.

    By "they" are you referring to Vodafone or Mobiles?

    I would say that since you have 14 days from receiving the sim to cancel without penalty you should send a LBA to CPW T/A Mobiles.co at its registered office giving them 7 days to reimburse you. State that if you haven't received a full refund by then you will immediately commence legal proceedings, at which point you will add court fees, any incidental costs and statutory interest. I have needed to go that route with CPW many times and always got my money - though I wasn't chasing the same charges as you are.

    Send a copy of the letter to Mobiles.co by email. Are you certain that Vodafone haven't kept the contract running? If they have you won't know until they chase you with a debt recovery company and have trashed your external credit files. Withoput knowing if they took monthly payments and without a Vodafone mobile number you're going to find it almost impossible to find out. I would therefore also include in the LBA that you require confirmation that they have cancelled the account with Vodafone without penalty.

    I disagree. They took the contract out through the dealer and the dealer failed to deliver the sim, so cancellation is a right through the dealer. It wasn't Vodafone's fault that Mobiles.co failed to supply the order and failed to notify Vodafone of the cancellation. There is no action against Vodafone, unless I'm missing something?

    As I read it the contract was cancelled according to the OP (on the 24th August), Vodafone still took the first direct debit payment which is what the OP wants back.
