Bins overflowing got fine for fly tipping

We live in a block of 14 flats, all large families.

We have only two large dumpsters for all 14 properties, they are emptied once per week. As soon as they are emptied on rubbish day, a day or so later they are full and overflowing. I go to take my rubbish out and either try to balance it on top of overflowing bin, or no choice to put it to the side because it would have fallen off anyway.

Have reported it multiple times to my letting agency and to my LL.

All 14 flats are owned by different people, some renters some owners and all different people.

Anyway, we get a letter the other day from the council with a £400 fine for fly tipping, apparently they found out address on some of the rubbish that the foxes and birds rip apart and make a mess.

I'm furious:mad: I reported again to our letting agent.

Everybody wants to pass the buck. The council say you need more bins, I say DUH, that's what we have all been saying for years.

Who is responsible to pay for more bins?

    I have bought another from our council, they just provide one free one but only recycling

    Were the "overflowing bins" on council / public property, or located on the private premises of the flats?

    They aren’t your letting agency. The letting agent works for the landlord and you have a contract with the landlord not the letting agency. As it is a flat you rent your landlord will be a leaseholder with the freeholder being his landlord.

    The buck stops with you on this one. You decided to leave your rubbish outside of the bin. I live in a block of 3 flats, each with its own set of bins and when my downstairs neighbour bought her flat she had a lot of work done and her workmen filled up everyone’s wheelie bins with their detritus so I ended up have to take my regular household rubbish up to the recycling centre myself which was a PITA it was either that or leave rubbish outside to get blown about by the wind and attract foxes and rodents.

    How have you reported the lack of bins to the landlord? In writing to the address for the serving of notices given in your tenancy agreement? The landlord then in turn would need to raise it with the freeholder. Alternatively, since you’re the occupant have you contacted the council requesting an additional bin?

  • Quite honestly if they start to overflow, wouldn't a trip to recycling depot be better than just making the problem worse?

  • I would rather take my rubbish to the tip (annoying as that is) than attract rodents to the flats. What recycling bins does everyone have? Do people seem to use them? Have you contacted the management company?

    They're 1,100 litre capacity. Times two. 2,200 litre capacity per week for 14 flats. That's 160 litre per flat per week.

    Our local authority has two sizes of wheelie bin - 180 litre or 240 litre - for houses and smaller developments of flats. The larger bin is only available to households of five people or more. They're emptied fortnightly - so a household of four people has 90 litres/week of bin capacity. For developments of more than 8 flats, they provide larger bins of equal capacity.

    Our bin (two person household) is rarely even half full.

    How on earth are the people in your flats producing so much rubbish...?

    As for requesting another - it won't happen. Councils have to pay to dispose of landfill waste, and allocate a certain amount of capacity per property.

    My council provide the bins with the size decided by the number of properties needing to use them. The size is restricted to encourage recycling. Do you have recycling bins and are they properly used?
  • People seem to be misunderstanding the OP. She doesn't have an individual bin, there are 1000 litre bins shared between all the flats. I have the same, there are no facilities to even separate cardboard out. As I don't drive, and the dump is miles away, (and no community services any nearer) there's not an awful lot the OP can do.

    I tend to fold any cardboard but I do take postage labels off and you can shred envelopes/letters up for data protection reasons.

    But yes, the OP is going to have to contact their LL. An appointment with the CAB might help see if there is any defence the LA will listen to. £400 does seem rather high for the odd envelope? Otherwise someone will have to organise a meeting with the other residents and discuss ways to minimise the disposal of rubbish, or applying pressure to the freeholder.
