    My understanding is this and I am prepared to be corrected, anyone seeking money only has to write to the last known address. Therefore, if you'd moved and not informed the company then the papers could have been served at your old address, you fail to attend court and a judgement is made by default ie as you didn't put up a defence. What exactly did the letter from the company involved say? How did they manage to write to you if they didn't have your correct address or did they track you down later?

    It is is quite possible you have a CCJ from my understanding of the process but wouldn't profess to be an expert.

As i was not given a chance, do i technically still have a CCJ? I am really confused about all this, it came as a shock to me when i got the letter, but because the company didnt have my correct address they just went ahead anyway!

    Thanks Paintpot, no, not on benefits, my hus works but does not earn enough money as per the Letting Agents 'Allowed Income' anyway, but I figured we would top up with HB if we could, because my husband lost his job (Industrial Asthma) he has to take a much lower paid job and it has stuffed us completely tbh as the field he was in made money, this one does not so much. We are hoping the compo he is filing for (nothing agreed or anything, could be years) but we are hoping that it will be enough to cover paying the debts that we incurred through this and that is what that money will be for, to get us straight and back on track, but while we are on repayments and have defaults it has messed up our credit rating and I have been honest and upfront with the peope I have been calling. No point otherwise really, you get caught out if you lie. Life sucks at times but you have to keep on smiling, right. I am still smiling (somehow, but I have my moments) but it is nice to get information than otherwise be worrying myself stupid over it. As I said, we have a lot of our stuff packed and ready to go, worst comes to the worst if we get evicted we'll leave the furniture and take everything else and ask mum if we can come back for it later (I am guessing I would still be allowed in the door with it being the family home).

    And it's OK, no offence taken. It has been a hard few months, it would not be so bad if she had said 'sorry but...' but she hasn't just I want you to leave. Not even that she was considering it. As somone else already mentioned, maybe the Karma boomerang will come back and smack me in the face - always doing stuff for other people while not worrying about myself. Who knows?

    The basic jist of it from memory (I've just been rooting through paperwork trying to find how it was worded) was that a judgement took place in my absence, my current address was then obtained and i was sent notice that i needed to make arrangements to pay the amount which was either installments, attachment of earnings or baliffs. I obviously took the easy option and paid the whole lot in one go, but sadly thats not going to have helped the fact it went to court in the first place, i also had to pay the court fees.

    Right, sounds very much like you got a ccj, view the following link that might help you. E.g. seems like you settled the debt from what you say, if you settled it within 28 days that could be your saviour but have a look at the llink, it seems fairly comprehensive.

    LOL, ah you see, optimism, I love it!! I'll be watching that sig though. I have to confess that I said to my husband that once stuck in that hostel I was going to start entering loads of competitions as I would have nothing else to do!!

    Seeing as you frequesnt that section, did you see that post on the Freebies board the other day about the buggy & car seat? Funniest thing I had read for ages!!
