Faulty Shark 7months old

Hello lovely People of MSE,


I bought a Shark Cordless DUO IFT200UK from argos at the end of Feb 2019 - I had a replacement part sent from shark to try and resolve the issue.


They then issued a returns number, however Argos no longer stock the model and wish to charge £100+ to upgrade to the 260uk.


Shark would upgrade without charging as thats their warrenty policy, So where do I stand, I don't wish to get a refund as would then have to pay the extra for New product.

    I don't follow. If shark will upgrade without charging via their warranty, why don't you go with that option?

    Because it's down to argos to replace/repair within 12months then shark in the 4 years after

    Yes and no. The rules changes after six months.

    You said you received a replacement part from Shark. Did you contact Argos first or go direct to Shark?

    First port of call was Argos, who told me to phone shark customer care, who replaced part of the machine and then after that not being at fault supplied a RMA number for Argos

    So Argos can offer a repair, replacement or refund. If they don't have the item in stock then a refund in reasonable.
    Bear in mind they could have asked for an independant report to show the fault was an inherent one as the item is over six months old.

    You either :


    Contact Shark and explain that Argos no longer stock the item and ask them to replace / upgrade


    or

    You accept a refund or an at your cost upgrade from Argos. Argos do not have to upgrade FOC.

    Not really. Shark offer a full 5 year manufacturer's warranty so if they're offering the upgraded model for no extra cost then what else do you want.

    That can be, at best, described as a loose understanding of Consumer Rights law.

    Shark told me, they only step in after 12 months on Replacements and they have tried to repair it, but it is not costly for them to send out MORE parts when the fault can not easily be traced
