    Dear BWLegal,

    Further to your letter dated xxx, I have noted your offer to which I decline.  You have not satisfied me that your claim is legitimate especially the addition of £60 which is unlawful.
    I therefore intend to proceed to court and refer this matter to the judge for his/her consideration. I trust your witness statement in this matter will comply to the new Civil Procedure which I will bring to the attention of the court.

    As you appear not wanting to waste time and money, I will now suggest a "drop hands" offer whereby your client discontinues all action and to bear their own costs and I in turn will not claim costs against your client.

    Please therefore advise me within the next 7 days

    Latest on this is that – due to COVID19 – the courts are offering to "determine on paper" (ie, without a hearing) if all parties agree. If a party does not agree they must state their reasons.

    I'm inclined to agree to paper determination.

    Any thoughts or recommendations?

    My thoughts are why would you agree to a 'hearing on the papers' when you specifically turned down that option earlier?

    During the last three months since your last post on here you will have surely read several threads that suggest strongly that a paper hearing is not a good idea?
  • I haven't read those threads, will do so now.
    As to why I would agree to paper hearing - there's a global pandemic and personal reasons mean we are still sheltering/isolating.

    when you read the threads you will see that it will most likely be by telephone ... or months ahead

    people who are sheltering and isolating can still take telephone calls or video calls, never mind paper hearings

    you should be reading those threads whilst you have nothing else to do , like the rest of us

    You will lose if you agree to a hearing on the papers - we've seen it before and NEVER advise it. 

    Think about it - solicitors do 'LEGAL PAPERS' for a living...you don't!  Of course your voice must be heard to show the Judge you are an honest witness, and to avoid old photos and template stuff in the other side's paperwork convincing the Judge because their papers look OK on the face of it, without you to say otherwise.

    You absolutely MUST respond quickly to the court and Claimant's solicitor and say NO THANKS.  Those words are in the TELEPHONE HEARINGS thread.

    You haven't been here since April and it worries me you've not read the threads covering this same question every week.  It worries me because in our experience, people who think defence is their only job, and disappear from the forum and make no hearing preparations, lose their case. 

    Don't be that person.

    I may have missed it but I am not sure you have even done your WS & evidence yet?
