Thank you for your report dated 13 October 2019. I am sorry for the delay in responding, this is due to a high volume of matters being received in recent months.
I am an Investigation Officer at the SRA. My role is assess matters to decide whether further action is required.
In this case, I can see you are concerned that BW Legal adopted an approach which you consider to be intimidatory whilst they were acting for Premier Parking Solutions Limited. You are also concerned that they provided you with misleading information by advising there was a notice of pending county court judgement and by indicating they would enter a judgement against you. I have noted their letter dated 7 October 2019 addressed to Mrs XXXXX also states a county court judgement may be entered against you and it refers to if a CCJ is granted. As you rightly indicate, it is for a court to determine the outcome of the matter.
It may help to know, the SRA is already aware of issues regarding the wording of the firms correspondence and we are in the process of liaising with them regarding this issue. Where we find evidence there has been a breach of the rules and principles relating to the professional conduct of solicitors, and it is appropriate to do so, we can take disciplinary and/or regulatory action.
In the circumstances, I confirm I have closed my file as the issues are already being considered. Thank you for bringing this matter to our attention and apologies again for the delay in responding.

Thanks for update. The door is still open on this, which is a bit unusual as the SRA is often very swift to slam it shut.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Just gone back to first post of this thread and it is for £240, which of course, includes their spurious £60, so effectively it is a discount of £20 on the original PCN plus court costs plus the £60 they are NOT allowed to seek.0 -

sra.org.ukNine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.
