I think I'm being conned by Allay (PPI)

  • Hi - Ok many thanks again. Tomorrow I will send a letter recorded delivery asking them to be kind enough to send me a copy of the contract I signed with them. ( I will not send by email as I have never had any from them and do not wish to start now.).

    It will be interesting to see if they send this, how long should I give them to respond? I know you said 8 weeks if I make a formal complaint to them.

    You are effectively making a Subject Access Request (SAR), so they have a month in which to comply..
    You have to allow eight weeks for any subsequent complaint you might make...
  • Hi, ok many thanks for clarifying that point re: the SAR - I am a little concerned that they may make a charge for this as I believe other companies do ?

    Also this morning I have received a text from them stating great news my lender has upheld my case and asking me to call them. Naturally I will not call them !

    Since GDPR, SARs are no longer chargeable.

    Unfortunately, this means the Bank have accepted whatever authority you provided the Claim Firm and have informed them of your success.

    Why would you not call them? You have nothing to fear from disputing their bill on the telephone.

    I wouldn't call them simply because then they'd have my number.
    Just send the letter of complaint.
    Dont spend the money either as you my well have instructed them via electronic signature until you know for sure either way.

    I think those details will already have been provided by the OP as part of the sign up for the "Free PPI check" on Facebook or wherever... The fact that the OP received a text from them also shows they already know..

    Earlier, I said the OP should keep a paper trail of the SAR and of any subsequent complaint, not that no telephone calls should ever be made.

  • Hi - just a quick update. I did call them today and the guy I spoke to was quite helpful unlike someone else I spoke to there a few months ago who I ended up having a screaming match with.

    Anyway basically he told me what I already knew that I would be getting some money, the amount and also explained the invoice, again all of which I knew.

    I also asked if he could send me a copy of what I had signed and he said he would send by email. This he actually did together with terms and conditions ! First email I've ever had from them! Also sent me a copy of the HBOS correspondence, again I already have this. He also said that when they send out cheques they normally do so at the last minute and then I should pay the invoice.

    So yes, I can say the scrawly digital signature could well be mine and therefore, I will pay their invoice. As said at the outset, it was money that I wasn't expecting to have anyway. I still cannot trace that particular account number. I have also just completed the relevant forms for HMRC to claim the not unconsiderable amount of tax back.

    Just hoping I won't receive any more invoices from them for failed PPI from a Santander account, again which I have no knowledge of.

    If anyone wants to phone them or anyone else and withhold your number, you can do this by dialling 141 before the actual number. That way your number is withheld.

    Be sure to fill in the R40 carefully and accurately. Others here have ended up with a huge (mistaken) tax bill because they didn't.
