I don't understand your ramblings, sorry.
We can see you're no expert on GDPR, that is clear though.
But from what you've posted I see no issue in the way that Co-Op and Link have acted...0 -
!!!,
I am not an expert on the GDPR and I don't believe the other companies wrote off my debts and took down the data on the accounts for commercial reason as was mentioned in an earlier post.
It is up to you what you believe and what you don't. However, the facts are the facts regardless of your denial. And that is that each of those lenders has looked at your personal circumstances and decided that they were unlikely to recover the debt from you and therefore decided not to waste any more time or expense in attempting to do so. They were not compelled to take this decision based on any legislation.
Eskbanker, has pointed out an FCA rule and I think the collection firm for Creation Finance, Shop Direct and Barclaycard did what they did because they were following the law as laid down in their industry by the FCA. If it was in their commercial interests they would have pursued me to get the money back.
And just how do you expect them to recover money from you in your current circumstances? Do you have and income? Do you have assets? Perhaps not in which case you know that they can't and so do they. Therefore, they have written the debt off.
The principals of data processing I think are being broken that is it must have a lawful purpose and must be the minimum amount et cetera et cetera.
Who provided them with the data?
So the whole case has been handed over to the ICO and the FCA and the PRA to examine if in my circumstances Link Financial Outsourcing and Co-operative Bank are doing their jobs as they should be. It is also the subject of a complaint to Link Financial Outsourcing's membership association called the Credit Service Association as I think they are in breach of their code of conduct on their members.
Can you specify what the breech is? Others may be able to give you an opinion if you specify the details.
You also have to note the company Link bought debts which were all interest the principal sum already paid in the circumstances I find myself in for less than £10 and yet continue to ask me to pay then back £12,000 might be legal but it certainly is not moral or ethical for then or the Co-operative Bank who they bought the debts from and have a duty to uphold the principals of the Co-operative Society they way they are.
Debt collection is not pursued on the basis of morality. It is pursued on the basis legitimacy and liability. If you feel that the debt was repaid and that any amount being chased is not due then you must coherently make your case.
Regards
James
The information that you have provided does not support a case of data breech. You'll need to elaborate on that if you want the guys here to give you any useful feedback. The same would also apply with the validity of the debt.
Whatever happens with these issues, it sounds as if you have had a tough time of late. I hope that you are getting the support you need and manage to get your life back on an even keel0 -
I think OP is arguing that he was traced down by the DCA's and this is a breach of information - apparently.
But it's not, and it's perfectly legitimate and legal for you to be traced by a DCA.0 -

Fair enough but if you think that's going to get the debt written off you're sorely mistaken.0 -
Boo_star,
Why would you make that claim?
If Barclaycard and Creation Finance and Shop Direct and others all except Link Financial Outsourcing who bought the debt from Co-operative Bank have written off the debts and there is an important point here:
They took down the CIAS/Insight/SHARE data with the 3 big CRA's
Why do Link and the Co-op continue?
You give the impression you know something about this case internally as to why my other creditors all took the specified action but Links Mr Hanson continues to view my TransUnion report and the company continues to attempt to collect what those others decided for a reason was to be written off.
I have made a SAR of them to request specifically what reason they had to do what they did in the instance it is based on any law, rule or regulation Link should be following to put in front of the Court of Session to get an interim interdict seeking that Link p**** off.
Do you know their Mr Hanson or the other names from that special TransUnion database they are searching that I see what they see everytime they go in for a look?
Kind regards

This has been explained to you already, I don't know why you're not getting it. They don't think they're going to get their money back and so they've written the debt off instead of throwing money away continuing to chase it. Link obviously feel differently. You give the impression you know something about this case internally as to why my other creditors all took the specified action but Links Mr Hanson continues to view my TransUnion report and the company continues to attempt to collect what those others decided for a reason was to be written off.
I know nothing about this case "internally." But I have worked for a bank in their debt management department so I do know a few things about their processes.I have made a SAR of them to request specifically what reason they had to do what they did in the instance it is based on any law, rule or regulation Link should be following to put in front of the Court of Session to get an interim interdict seeking that Link p**** off.
An SAR is very unlikely to get you a reason, unless they've recorded that on your file (and I don't see why they would have.)Do you know their Mr Hanson or the other names from that special TransUnion database they are searching that I see what they see everytime they go in for a look?
I'm not sure what you're asking, could you rephrase that?0 -
As already said - they’re not obliged to write the debt off just because others did.
I don’t understand what you are failing to understand.0 -
I wonder if the OP is pointing out in his or her circumstances that he or she prove that Link Financial Outsourcing are not acting legally, mostly or ethically.
You just have to look up a Co-operative Bank sponsored Citizens Advice Debt Management project in Manchester CAB to see the rank hypocrisy.
In my humble opinion any judge in this country of ours that give then a CCJ/decree in the circumstances the OP finds themselves would be staring their own P45 in the face.
John
And the OP has yet to tell us how they're acting illegally.
Morals and ethics are not relevant here.0 -
Op has another rambly mad post on the benefits board, weirdly JDoe58677 has just joined up today to post on their post there as well.
I’d think they were the same people, but surely they’d be smart enough to hide it better... no?0 -

Oh, I'm pretty sure the new poster is a sockpuppet.0
