Hi All,
Many many moons ago, I started a thread relating to a ticket I was issued by Civil Enforcement ltd. This thread has since been locked.
https://forums.moneysavingexpert.com/discussion/6044428/civil-enforcement-ltd-have-i-left-it-too-late-for-a-popla
Given how long ago this all happened I had assumed that it had all blown over but I have today received a "Claim Form" from the County Court Business Centre.
Given that Civil Enforcement have previously sent letters from other "organisations" trying to get me to pay, I am assuming that this is yet another "pay now or else" letter but I wanted to check in with you guys first. Having just had a search of the forums it looks like it is from a legit County Court but I have no idea how to check.
The "violation date" was the end of June 2019 so it's 2 and a half years ago, surely there is some sort of limit on how long they can keep this going?0 -
6 years is the statute under the LImitations Act 1980
You now have a live court claim , so what is the issue date from the claim form ? ( It's definitely legit )
PM a request to soolin or savvy , ask them to unlock your previous existing thread and merge this thread with it , for continuity
Email a SAR to the DPO at CEL attaching a copy of the claim form as proof of I D under the GDPR law to obtain all your data , today
Read the newbies FAQ sticky thread Plus the defence template post by coupon mad too3 -
It will be a genuine County Court Claim Form.
You could always ring the County Court Business Centre to check - google their phone number - do not rely on the number printed on the form if you believe it is bogus.
What is the Issue Date on your County Court Claim Form?
Yes, 'there is some sort of limit on how long they can keep this going'.
It's six years.4 -
DM fired off to Soolin.
Ok, so CCBC is legit. I did google them but I couldn't then decide it this was just another shell operated by Civil Enforcement.
Six years is annoying! Date on the form is 22 Dec 2021
I'm a bonafide dyslexic so looking at paperwork like this is a nightmare for me. Are there template SAR forms around here?
Just tried to call the Court to confirm the details but I was number 29 in the queue so decided to leave that for now.0 -
FernandoYoghurt said:Date on the form is 22 Dec 2021With a Claim Issue Date of 22nd December, you have until Monday 10th January to file an Acknowledgment of Service. Do not file an AoS before 24th December, but otherwise there is nothing to be gained by delaying it.To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an AoS in a timely manner, you have until 4pm on Monday 24th January 2022 to file your Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.4 -
Redex,
Found the SAR template in the Newbies thread (correct at time of posting)
https://legalbeagles.info/library/guides_and_letters/court/subject-access-request/
and for the record, the DPO at CE is;
dataprotectionofficer@ce-service.co.uk
SAR sent.
Thanks for that advice.
Keith, thanks, I'll start looking through the AoS paperwork now (but not do it till after Christmas).1 -
It's not paperwork, don't use the forms. This is all explained in the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
