    No it isn't. The Interpretation Act1987 (s7) provides that delivery is deemed to be effective "unless the contrary is proved", placing tho onus on the addressee.

    Yes, and that proof must be shown "on the balance of probabilities" (i.e. more likely to be true than not). This is a considerably lower burden that "beyond reasonable doubt".
