So let's have something the OP could work with if he gets a late NIP.
You probably know that cases in Magistrates' Courts are not documented for public examination.
Generally, turning up and saying "Didn't receive it" will not cut the mustard, as you say. But the defendant may be able to persuade the court that he has had, say, otheer difficulties with his post ("the dog ate my mail" similarly is unlikely to wash). It's a difficult defence with which to succeed; I'm not suggesting otherwise. But a success is not unheard of. There's nothing to "work with". If a defendant wants to give it a run he must be aware he faces an uphill task and unless he has some corroboration regarding the delivery date he is more likely than not to fail. If it was easy everybody would do it.
Genuinely late NIPs are extremely rare (if for no other reason, the system that produces them prevents them being sent out late without manual intervention). Hopefully this OP will not be faced with such a dilemma.0 -

But you said there are plenty of cases. Where do you get that from if they're not documented.0 -

Because I've witnessed a small number myself and know other people who have done likewise. You can believe it if you wish, or doubt it if you like. Makes no odds to me.

Of the rare genuinely late NIP's? Of course you have because you've written it online.0 -
I had this a few weeks back, I went under a gantry showing a 50 limit just under 50mph and got flashed (it was definitely me as amazingly I was the only vehicle passing in any of the four lanes at that point), when I got to the next gantry it was on 40. I then went on holiday for two weeks and half expected a NIP when I got back but luckily not. I think it would be much more user friendly if they didn't flash immediately after a change.
There is a one minute “grace” period between the gantry speed signs changing and enforcement of the speed indicated taking place.
I am always curious as to how anyone (prosecution or defence) can prove at specifically what point the speed changes or indeed what speed is indicated. Although I no longer use the M25 regularly I still do so about 2 or 3 time a month, especially on the western section near Heathrow. Often 3 of the lane signs will show say 50 mph but the fourth will be blank. And often the blank is in lane 2 or 3. How does that work? Because as we all know the limits are lane specific, not general. Perhaps a good reason to have a dashcam?0 -

As well as the log mentioned, many of the more recent cameras in use covering variable speed limits take a simultaneous photograph of the vehicle and the speed limit displayed.

So if you didn't receive it for some reason you are basically screwed? Guilty until proven innocent? That doesn't sound right.
The burden of proof is for them to show that you received it, beyond a reasonable doubt.0 -
