Also, it's "claimants have" OR "claimant has."
  • Grammar corrected as per above

i added a new para (after 13 in the above versions) where i talk about the grace period - this is following another [URL="https://forums.moneysavingexpert.com/discussion/5971673when the OP mentioned this and judge used this

    14. Furthermore, I must add that the grace period was agreed to be changed to exceed 10 minutes and be set to a minimum 11 minutes at the Professional Development & Standard Board meeting by the BPA.

The minutes (Exhibit NFR013) of the above meeting on the 30th July 2015 state the following:
Implications of the 10 minute grace period were discussed and the Board agreed with suggestion by AH that the clause should comply with DfT guidelines in the English book of by-laws to encourage a single standard. Board agreed that as the guidelines state that grace periods need to exceed 10 minutes clause 13.4 should be amended to reflect a mandatory 11 minute grace period.

its a minimum period too , so emphasise that aspect , its not set in stone as it can be difficult to exit car parks in time too, especially busy ones etc
  • ok great - plus i can emphasis on the signage being misleading
its offer 1 hour free parking but the small print if you do not pay with 10 minutes or arrival or if you park longer than the period paid for, you garee to 100

but what i dont 'pay' as im using the car park under the incentive of it being free for 1 hour

Do you have your own photos of the signage, with sufficient focus to read the small print?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Is it one of those car parks where you have to obtain a ticket for the FREE element of the parking? A car park outside our local railway station gives 20 minutes FREE parking but you do have to press the green tick button to get a free 20 minute ticket.

My point is "how do you pay if you are going to take advantage of the free one hour parking?" I guess this is the same thing you are saying, have you/can you post(ed) the photos of the signs on here so we can comment?
