Exchanging delays! Help

  • Well due to exchange today but this is pending the lender having responded so whatever the likelihood of that is im not sure?

    Varies so much from lender to lender one would think.

    So the solicitor sent off the matter via email yesterday morning.

    I wonder what the chances are of a reply to go ahead today would be????

    Really could do with getting over this line today for my own sanity over the Bank Hol Weekend.

    I'm utterly confused.

    I have never heard of a lawyer messaging a lender and saying there is a pavement in front of the house.

    Are we 100% sure that it is just referring to a pavement / Public RoW? Are you able to add the exact wording that has been used, if possible?

    I know.

    I really don’t know what the issue is because it is 3rd hand information really.

    It is our buyers solicitors who have contacted their lender – Our estate agents have reassured us saying it is just due diligence and
    Nothing to worry about.

    We are the last house on the estate detached and our driveway is private however the pathway at the front of our house allows passers-by to use it.

    As far as we are aware that belongs to the public and not us as set out in a boundary map.

    I am just hoping this isn’t going to cause an issue at this stage after 9 months of a roller coaster we are hours from exchanging.

    I can understand your frustration. It sounds like the buyers solicitor is being overly-cautious, but from what you've said, it doesn't sound like an issue at all.

    One thing you could do, if you are directly in touch with your buyer and have a good relationship, is to ask them to chase their mortgage advisor to chase the lender and push the point that exchange needed to take place today. Most mortgage advisors have direct contacts with lenders and can get things pushed forwards if they are aware of them.

    However, if you're unsure at all as to how your buyer may react to being pushed like this, I'd leave well alone. You don't want to make them jumpy over a trivial issue.

    Almost certainly, for obvious reasons, the solicitor can't be talking about a pavement that is clearly not on your property.

    If you are comfortable sharing the RM ad for the property, people might be able to have a look on Streetview and give you a more informed opinion.

    Someone must have told the sol about it or maybe has miss led them. Time to call your EA up or speak to your buyer and find out what's going on. Could they be looking for a way out?

    I would like to think this isnt the case as the solicitor has detailed to the lender that the buyer agrees to the pavement belonging to the council

    This must be so stressful, but really can't understand how it is being dealt with so late in the day .

    A pavement won't cause this furore so not sure what is happening.

    Fingers crossed for an exchange soon
