The only thing holding us back from exchanging tomorrow is that our Buyers solicitor
Has sent a notification email over to the buyers lender to advise of a footpath near the house being a footpath
That the public can use and not just the owners.
Apparently we have been reassured this won’t be an issue more a trivial thing but
The annoying part to this is that the lender might not respond for a few days (Would this be the norm)
Is there much chance of any that the lender will respond by tomorrow in order to exchange?
Everything else is good to go!
Can’t help but be very nervous as we have been on a 9 month journey with this!

Presumably exchange and completion wasn't to be on the same day anyway...so even if you don't exchange tomorrow theres still wriggle room to get to your proposed completion day.in S 38 T 2 F 50

Yes that’s correct
It was due to be
Exchange 23rd Friday
Complete 30th Friday
Just feel nervous the longer it goes past Friday!
Its been a rough ride so was looking forward to a glass of bubbles tomorrow night.
Thoughts of the wait all bank hol weekend is a little nervy0 -
I'm surprised that a public right of way over the land being sold is only coming to light at this stage. Was it not shown on the LR maps? But, yes, the lenders do need to know. I can't imagine it's the end of the world, though.
How long will it take for the lenders to grant go-ahead? Only the lenders can answer that...0 -
The OP says "near the house", no mention of whether it's on the plot or not, but why would a footpath be relevant if it wasn't on the plot?
OP - can you clarify, please?
Yes that’s correct.
It was never belonging to us! The path is at the front of the house so people passing can use it.
The buyer has said she has no issue with this and the solicitor for the buyer has also said this to the lender (That the buyer is fine with this)
At no point was this path ever belonging to the property. It is simply just at the front0 -
<boggle>
Something like 99.9% of all properties in the country have a public right of way passing right next to at least one boundary...0 -

Yes but it is so obvious why does the solicitor feel the need to contact their lender about it0
