New incapacity rules

I have been reading about the new IB rules that are coming in next October. I am NOT on IB, bur was wondering if all of this will have an affect on people on DLA? I am on top rate care and lower mobility awarded indefinitely in September. I am also on IS and severe disablement allowance. Are people on DLA going to have to have tests to see what they can do to go back to work, or is it just people on IB? sorry if this is muddled, but I am confused :rotfl:

You're not the only one, my missus is on DLA indefinitely & it worries me that they may try to force me to go out to work even though she needs 24hr care. I can't do both.Winnings

I am worried cos there i no way on the earth I could work. I can't go out of the house on my own most of the time due to severe mental health issues and acrophobia:j £2 coins = £2.00 :j0

The changes to IB are not related to DLA, they are seperate benefits. People on DLA can and do sometimes work full-time as it is not to do with whether you can work but your mobility and care needs. To begin with the changes are only going to affect new claimants but it looks likely it will affect old claims eventually if they have the resources and this may include those on SDA but the legistlation is not final yet.0 -
The new rules will have NO effect on DLA. It is an entirely seperate benefit.
Also, the new ESA will only replace IB for new claimants. People already on IB will stay on IB.
So don't worry0 -
but it won't affect those on DLA? I am on SDA, been on it since I was 19, so been on it along tme. Oh well, it sounds the changes are a long way off, so won't worry for now:j £2 coins = £2.00 :j0

Incapacity Benenfit and DLA were connected before the new scheme came into affect in October.
If you had been awarded the highest rate ofr personal care for DLA it made you exempt from having to take a Personal Capability Test [IB50 etc:] for Incapacity Benefit.
I have not been able to find out anywhere if this exemption is the same for the new ESA as there is bound to be some sort of test [Personal Capability Test, All Work Test whaterever they decide to call it!]
Yes, I know that the ESA is about deciding what you can do, rather than what you can't; but if you have been awarded the High Rate Care then it would be very unlikely that you would be capable or able to do any work the Job Centre could offer.0 -

ESA does not come into effect until Oct 2008, computers permitting!0 -

Not a very helpful post.I have never heard of "Swinging the leg" before! I suppose people can do it whilst shelling peas!0 -
Swinging the lead - A person pretending to work (or claiming to be ill) when he is not.
Pre-modern days, seamen would check the depth of water by dropping
a lead weight, attached to a thin marked rope, to the bottom of a
waterway. Some lazy sailors would take as long as possible about it.
They would swing the lead to and fro several times instead of just
dropping it straight into the water.0
