When they had no photographic evidence, which would have been absolutely vital for them to prove their case? You could not possibly have lost this. They would not have even dared putting this in front of a Judge.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I know but it didn't seem fair for my dad to get harassed by these bullies when I had the car that day. He's the only reason I'm on the road so I did it out of respect but gutted I'm £60 down when i really can't afford it. X

But he could have named you as the driver, then the parking charge would have been switched to you.

They still wouldn't have had any evidence, and you'd still have your £60 in your pocket, not in the coffers of a scammer.

Why didn't you ask for advice before signing that cheque?

  • I didn't know that was even an option as I've never received a ticket before :(

A simple question to the forum 'Are there any other options open before I chuck 60 quid down the drain' would have given you the option for your father to name you as the driver.

Learn from this, but come back if you/father receive any other tickets. Naming the driver is only a sensible option in a limited number of cases (this being one of them), so don't ever do that unilaterally until you've checked with us.

Better still, avoid any car park with a private parking firm involved, or if you can't, read the car park signage, comply with it absolutely, and you won't ever get a ticket, and if everyone did this, PPCs would quickly die and fail to exist. A very straightforward equation, but I suspect that another 7 million motorists next year (possibly higher than this year) will ignore signage and believe they can park wherever, whenever and however they please.

    £100, kerching!

You didn't ask and your posts make no mention of your dad being the registered keeper. Sadly the communal crystal ball is on the blink.

    What??

You didn't know it was an option to ask for advice?

You never even said "I'm thinking about paying it".
  • I have been incorrectly fined by UKCPS for leaving site at Ravensfield Retail park in chesterfield, the only evidence they have provided is a photo of my car.  I sent an appeal off , requesting a copy of the CCTV footage and they replied with a standard letter, but in the body of the email it also said they would reply within 28 days, which I misunderstood mean that they were looking for CCTV footage as their standard letter did not state that they wouldn't be providing it.  We are no 28 days on, I have received a  final invoice for £130 and a threat that they will take it to the county court.  I phoned them but they said I have not appealed to  the IAS in 21 days and have told me I don't have a leg to stand on.    My view is that as I requested the evidence that I had left site they should have provided it, or at least told me that they would be providing it so that I had tome to make a further appeal. I don't think that it would stand up in court because they cant provide evidence..  What are the views of the forum please?

@JulieSuzanne - you need to start a new thread of your own rather than hijacking one that is now over 12 months old. You do realise you agreed not to do this when you signed up to MSE just a few hours ago?

Have you read the NEWBIES FAQ sticky, first post, yet?  Please make all responses on your own new thread after reading the NEWBIES FAQ sticky. Then we're not having, yet again, to start from first base.
