I've now looked at it but suspect most posters won't have done, because it involves downloading a link.
It looks like the person who 'signed' this agreement may not have done, and he is only someone who works for the Managing Agent.
Your WS needs to point that out to the Judge - where is the evidence of a chain of authority to UKCPM flowing from the landowner themselves?
The document looks like UKCPM created it. Suspiciously, both places where the signature of the MA is needed, an electronic signature has been plonked in, but they both differ in type font like someone has made them up...and why is the 2nd 'signature' not dated?
Can you track this 'Rick' guy down and email him a copy and ask 'did you sign this or did UKCPM create it?

I have received a supplementary witness statement from Glastones again by Mr Chapman with his electronic signature. This time his address is stated to be 49 Station Road, Polegate, BN26 6EA. I have googled this address and this seems to be a virtual office rental address. I think this is a further proof that he did not write this statement as he would have put the right address on the statement. I tried to search and cannot find that anyone else got statement with this address.
Briefly they have refuted they were managing the car parking spaces which formed a part of another title and this is a lie. In their previous statement they attached a map showing where they signs were placed which included this other title as mentioned in my WS.
They are stating that the Law Commission have found that electronic signatures are capable in law of executing a document. Mr Chapman also confirmed that he authorised his electric signature.They have denied all the ponts I have made etc. There is a lot to go through.
I will now have to draft a supplementary WS. How annoying.1 -
You dont have to. You can given your evidence in chief and refute the points then
Have they actually stated it is a lie? Can you prove them wrong in this?0 -

No they did not state it is a lie. They stated that they did not manage the car park spaces in question. I will try to prove this is incorrect and I'm trying to obtain photos from 2018 with their signs above the car park spaces. My argument is that they did not have all the relevant authorities from two land owners, only one and they were managing the whole industrial estate.nosferatu1001 said:You dont have to. Whats the relevance?
If they say they dont manage those spaces - then what does that mean for your defence? Please explain as i dont get it.1 -

15. When entering the estate there were UKCPM signs placed above another Company’s signs. In my opinion it would have been impossible for any motorist to decide which signs were in operation. These signs were removed around 6 months after the event. See attached Exhibits AK09 – photographs of unclear signage.
16. UKCPM signs state to park wholly within a marked bay. There were no marked bays anywhere on the estate at that time. The only marked bays were at the end of the estate and these parking bays were removed from the title for exclusive right of the owner of an industrial unit (title number XXX). The vehicle in question was parked in an area where again there were no bays or any markings.
I feel this is relevant to my defence because any purported contract became void due to impossibility of performance. I do hope I am right on this and would appreciate any comments.
However UKCPM had signs placed above the aforementioned parking bays which belong to a different title and for which they are stating they did not manage. Why place their signs there then? I think I can get photos of the signs at the time. Would this help my defence or is this not relevant at all?
Secondly there are no images that show marked bays anywhere else on the estate as they are now claiming and I have images to prove this.
