Complicated Situation - Help needed regarding CCJ

Options
Hi Guys, (for a family member so when i say I it means family member)

I took a payday loan out many years ago and i was going through a tough time. The company name was different money. Basically couldnt end up paying so went to court and got a CCJ. However a repayment plan was made every month of £25 through a pension which i got . The CCJ was in 2016 and is due to finish payment this month. Two questions:

The firm has gone into admin and has actually ceased trading. There is no way i can contact them at all, they have vanished from the face of the earth.

Question 1 - If a claim is to be made about refunds or redress - where do i go? how do i start?
Question 2 - Will the 25 stop automatically, if not who do i contact for it to stop? How do i get a certificate of satisfaction?

This is odd as i am sure no-one has been in this situation before.

Any help appreciated

would be the place to start
  • I believe that you (or your family member) would need to contact the administrators. Which PDL company is it?

The company was wound up a couple of years ago so you won't be able to get any money from them or the administrators.

It's possible the loan book was purchased by someone so it's presumably them collecting the money. I imagine the administrators will know who.

just so i am clear as my opening post maybe wasnt, the 25 pound was going direct from the pension to the creditors. It wasnt coming to me first so i could pay. I cant tell the pension lot to stop paying, its down to the creditior. But as there isnt none, i guess i have to go to the admin. I hope they can stop this

To be able to answer your first question you need to confirm how the payments are being made? (direct debit / standing order / other)

Also... where is the payment going? Is it straight to the court? Or directly to the company?

Certificates of Satisfaction are issued by the court. Here’s a good link explaining:

payments going through pension i recieve direct to my bank account. But they were 25 pound short each month as the pension directly paid the company. Not sure how the pension was paid to the company because i was not in control of it. I didnt even see the payments go, just that it was 25 short each month.

This was due to me being sent one of those forms which money is taken from your wages. In this case there was no wages just pension, so it went direct from there.

I understand i may need to apply to the court for one if the company doesnt send notification however the court wants proof the payment is paid through bank statements or something but i dont have that. So how can i proove it them

So tick the box that says you're unable to prove you paid it and explain why?
