Horizon parking court claim

Leave it in but unbold it, give it a paragraph number and combine it with the section below to make one bigger paragraph 11 and then continue numbering each paragraph sequentially.
Just had a thought, do I include my wife's title i.e. 'Mrs' before her name or just her name alone? Also, right at the top of the defence where it says 'IN THE COUNTY COURT' should this be edited or left as is?0 -
I would use whatever is on the claim form from Northampton CCBC. Most defences posted by the legal types, plus other equally informed posters have the same heading, so, providing you follow the lead of, say, Bargepole you should be fine.0

Done, now waiting for the confirmation on MCOL. After how many days should I chase them up if it's not showing as received?0

They've acknowledged receiving it, that was quick!0 -
Latest update. I have typed what was received below, verbatim.
I received a 'Notice of Allocation to the Small Claims Track (Hearing)
"Deputy District Judge O'Connell has considered the statements of case and directions questionnaire filed and allocated the claim to the small claims track.
Unless the claimant does by 4.00pm on the 17 February 2020 pay to the court the trial fee of £25.00 or file a properly completed application (i.e. one which provides all the required information in the manner requested) for help with fees, then the claim will be struck out with effect from 17 February 2020 without further order and, unless the court orders otherwise, you will also be liable for the costs which the defendant has incurred."
Does this mean I've won? I simply need to turn up to the hearing and that's it?0 -
Not necessarily , do not assume
You haven't won until the fat lady sings
Wait and see what happens , but do not miss your own requirements and deadlines0 -
No, it does not mean you have won.
It means the scammers/scamlicitors either have to pay the court filing fee, or send in an amended (proper) particulars of claim.
If they do one or both then you will be going to court. If they do neither by the date given, then you will have won.
Assume therefore it is still going ahead, but draw up your costs schedule. If you think the scamlicitors have acted unreasonably (with regard to the court procedure, not the parking scam itself) then add in further costs as per the relevant part of the CPR.I married my cousin. I had to...I don't have a sister.

How can you read something about the future date and think this means youve already won?
No
You have not "won"
This is the utterly standard letter
They will almost certainly pay the hearing fee and the claim will not be struck out
As this has been allocated to the small claims track, their liability for your costs is really limited.
You need to get cracking on your WS.0 -
I am preparing the WS, do I need to send a copy to the scamlicitors too? If so, would this be by email?
I will post a copy on here for feedback before sending it to the court.
Also, I have video evidence-how would I send this to the court?0 -
It must be sent on a 'durable medium' to both the Claimant and the Court.winner1111 wrote: »I have video evidence-how would I send this to the court?
A 'durable medium' is something that once sent cannot be altered by the sender.
In the case of video, that means you are effectively limited to either a CD/DVD, or memory stick/card.
A video file as an attachment to an email is another example of a 'durable medium', but you might need the explicit agreement of the court and the claimant to accept evidence that way.
A link to a Dropbox file, a Youtube file, or indeed a link to anywhere, is not acceptable as you could alter that file after the link has been sent.
You also need to consider how you are going to show the video at the hearing. Take a laptop or tablet with you that is capable of playing the chosen durable medium.0
