Do they seriously not give you 'OTHER'?!
If there are only those three awful choices, choose the last one, yes, as it doesn't say who parked. Then put the template words in as the appeal for those two (make sure it's for the RIGHT two - were they issued on the same day?).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Not 39, over 30. Some spent helping people charged with murder, !!!!!philia, theft, smuggling gold into Burma, possession of drugs, battered wives, (lots of those in Houston), losing passports, serious illness, death, asylum, mental illness etc.You never know how far you can go until you go too far.0 -

reading other recent INITIAL threads for Fistral, it seems you can choose keeper but then they have loaded questions, another poster was complaining to the BPA recently about this sc@m and the BPA seemed to think that because they offer KEEPER at stage 1 then Initial are ok to trap the driver at stage 2 - diabolical I know (possibly the Minniesox9 thread ?)

the signs at Fistral Beach are for £100 , not £60 , the £60 is the early payment bribe, but if not paid the daily default tariff of £100 is charged, plus any court fees

personally I would always appeal and not pay up
however, that is your choice to make , not ours, once you have the correct facts
I would go along with doing what CM said, but know what you are in for , hence why I have given you more info
Any pcn that fails POFA means the keeper has no liability in law , no matter what anyone else did
the rest could be appealed in the manner described earlier, where the BB holder is neither keeper nor driver
Initial are new to the game, but that car park is notorious and has had many parking operators over the years , previously its been Parking Eye and then Smart , with similar issues
I can understand how a BB holder may not check the rules for parking , but not able bodied samaritans who are family members and helping the BB holder
I am a BB holder and have been since they were orange , ut over the last 7 years I have learned a lot more about it so always check signs and insist my family do so too
I doubt that there were any payment machines or signs near any disabled bays, so was the vehicle in a disabled bay ?0 -

The contract between the Landowner and PPC is quite basic, is this the full contract?
BPA cop:
7.2 If the operator wishes to take legal action on any outstanding parking charges, they must ensure that they have the written authority of the landowner (or their appointed agent) prior to legal action being taken.
The contract doesn't give the PPC any authority to take legal action on outstanding parking charges.0 -

Good spot. Plus, no names of signatories to the contract, just two squiggles. Could have been the cleaner!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Is this something I should note for the second stage appeal (after I get the POPLA code)?
Also, in the newbie thread it says I should also contact the landowner to ask for the PCN's to be cancelled. Is there a template of what to say? (I don't want to reveal who was driving.) On an old post from parking prankstar on a different website, about 5 years old, I found out that the Car Park is leased from the council to Britanic Industries. Contact Jon Briant Tel 01637 872 489. Not sure if this is true/in date info.
